IR2 NVC Stage

I am petitioning my 12 year old stepson. We finally received our NVC case number, submitted the DS261 and paid the AOS fee. We are gathering the documents to be sent to NVC. Should I use  the 1-864EZ? The only person listed on the petition is my stepson. The income I am  using to qualify is based entirely on my  salary (I have W2, ITR transcript to show this plus pay stubs). But I file my taxes jointly with my wife. Would this be an issue? Can I still use the  1-864EZ?

 

For the AOS/IV Packet, we will be submitting the Document Cover Sheet, beneficiary's birth certificate, beneficiary's bio page of passport,  AOS form, W2, ITR and paystubs. Am I missing anything? Do we need to send My Wife and I's Marriage Certificate at this stage again? I'm also confused whether to include  2x2 photos of the beneficiary, I don't see that requirement on the welcome letter NVC sent us. Can we submit this instead during the interview at the embassy?

 

Based on what I read on the forum, I can send the AOS and IV Packet even before we pay the IV fee. I am still unable to pay it on the website. I will try to call NVC to see if they can unlock this for us.

I am the petitioner for my mum and used I864EZ even though I am married filing jointly. My immigration lawyer friend who we consulted with agreed this was correct. I meet the requirements from my W2s and I sent a copy of my W2 and also included a copy of my wife's (as it says to send all W2s and 1099s related to the return) but hand wrote on hers that it was sent only to show the breakdown of our income and that I am the ONLY sponsor. I haven't heard anything yet as I sent all docs a few weeks ago....

Thanks for the reply. Since you used the I864EZ, did you only attach a photocopy or transcript of your most recent year's tax return or did you do the optional last three years?

I only attached the most recent years tax transcript since my w2 from the previous year was a little too close to the required amount as I'd had a nice pay rise this year. My attorney said if it doesn't help the case by showing more money then we leave it out. I also checked and my wife also only included the most recent tax return when sponsoring me for my green card a few years ago.

We are in the  same process not many stepchild cases in the forum We used the I-864 cause my husband only income for last year wasn’t enough since we filled together I also filled I-864A and sent irs transcript,1099,w2, job letters and last 3 paystub from both of us copy of my husband passport(petitioner) and my green card, also marriage certificate our case was completed today 6 weeks after they received all documents, just waiting for the interview.

 

PD picture is not necessary; I heard is better to wait until you paid all fees and filled out all forms before mail out the paperwork that’s how we did
