I have held a 10 year card since 2002 so I am on my 2nd 10 year card.   At the end of 2016 I was officially divorced and then as of July 2017 I remarried to a different US citizen.

 

Would I be eligible for Naturalization under the 3year marriage rule (as my previous marriage was 16 years) or do I have to wait until I am married to my current wife for 3 years.

Or

Would I be eligible under the 5 year rule as I've had a greencard for 15 years or does the fact that I got divorced last year and am not 5 years into card 2 exclude me from the 5 year rule?

you are eligible to file today if you choose based on permanent residence in the US for more than 5 years - you said 15 - you're good to go.... The Permanent Resident Status is exactly that - Permanent -  The Green Card is just proof of it with a picture you have to change every 10 years - Your status does not expire....Or better said - the status drives the green card and not the opposite...

  • 07/30/2007 After no touches and no other signs we just got an email with the APPROVAL of I130....Thank God !....now what ?

  • 08/07/2007 Case received by NVC and case number assigned :))

  • 08/13/2007 DS3032 and AOS bill were generated

  • 08/14/2007 Emailed choice of agent ...i'm so curious when they will accept it...hopefully soon

  • 08/21/2007 DS3032 and AOS fee bill arive in mail

  • 08/27/2007 paid AOS fee bill
  • 8/28/2007 DS3032 choice of agent accepted
  • 9/3/2007 IV fee bill generated
