I appreciate your response. My husband is a us citizen and am due for an interview next month.meanwhile we included her to my case while my husband was an green card holder. But she was later asked to be filed for. While checking the time line we saw that there was no enough time.so we decided to file a tourist visa for her then later the i130

Slim chance if they see one of the parents is USC and the other is intending migrant.

I've been in this exact position (tourist visa application got denied for my then 9 months old baby) so the baby has to get I 130 to travel to the USA.

Thanks alot. If I may ask does it mean I have to leave my baby behind? And is there a possibility of expediting her i130?

when do you think you will get your Immigrant visa in hand? and have you started I 130 for the child?

I suppose you have to enter the USA close to the end of the expiry of your own Immigrant Visa (usually it will have 5-6 months validity for you to use it to enter the USA) to activate the GC, then return to your home country after that. This is so that you will have a longer time to be away from the USA to wait for the child's I 130 process. (you can leave the USA up to 364 days before your Green Card is no longer a valid entry document into the USA).

I have not heard of the possibility of expediting I 130 for a child unless you have legitimate reason (and they have lists of reason to expedite the process).

Others might chip in with better suggestions.

Am sorry to bother you. So how long did it take you to have your child with you in the US

I am still in the waiting process. Filed I 130 back in June this year so hopefully June next year i will be in the USA with my whole family. (my family is in our home country at the moment and i have applied for re-entry permit after activating my GC - so i should be okay staying out of the USA for the waiting period).

hence my family cannot make a move to the USA until this is settled (child getting immigrant visa) and i hope my application process will be smooth.

No worries, all the best and i hope others can give better suggestion.

Have you looked into if the baby isn't a usc since his/her dad is?

My husband became a citizen after our child was given birth to.

and that is the child you had with your current USC husband? And that child was born in wedlock?

Hurm... Child of LPR can get LPR status upon entry at any PoE IF the LPR apply for travel document at the local consular, and travel into the USA with the child turns 2 years old - and that travel should be the first travel into the USA for the LPR  after the child was born.

But if that did not happen in your case i assumed, as in the child has no US visa/status right now, and is the child of a USC, I-130 is the only method i am aware of.

I'll wait for more experienced forum members to comment on this.
