Fly to other state for Christmas while wife K1 visa expired

Me and my wife are planning to visit my parent in Texas from Michigan this Christmas. On her Peru passport, her K1 visa expired this week and we got married last August and already filed and in process for green card. My question is that is it safe for my wife to fly to other state while her K1 visa expired? Is her Peru passport acceptable? If yes then is there anything she need to take with like State ID, Notification letter of proof that she filed for AOS, etc?

The K1 is a one time entry and expired the day she arrived.

 

She should travel with her passport, state ID, marriage certificate and NOA 1 from filing AOS, especially going to TX where

they like to pull people out of line and ask randomly if they are a USC as happened to us.

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

As long as you are only traveling domestically all you will need is a form of ID acceptable to the TSA as there will not be any dealings with immigration officers. I promise you however rude they may be they will not snatch you out of line and deport you. Also if she has a state ID that is acceptable to the TSA(some aren't now) that would be best because there will never have a reason to question where she is from.

Ok so having all these requirements for her to bring that you mentioned should be okay to fly? Is there something we should be aware of in case one of TSA are dumb enough or rude regard about her immigration status?

Traveling domestically is not an issue.  You will NOT be dealing with immigration officers.  TSA will not check your immigration status. 

 

Just bring ID, and if your are overly worried, passport and copies of marriage certificate and NOA1. 

 

You'll be fine.  Nothing to worry about.  You are allowed to travel within the United States.  You just can't leave the USA.

Yes, that's all and no nothing else to be aware of, just show the papers mentioned if called out and you will be ok.

They snatched us out of line and asked if my husband is a USC, he replied no and then was asked to show papers proving he was here legally.
A state ID would not have been sufficient and border patrol will randomly call out people in line traveling domestically.
The advice "just bring your ID" is no longer sufficient.

Wow state ID alone is not enough? Ok I will make sure she will bring her Peru passport, NOA letter for AOS, and our marriage certification.

Yes, especially when traveling in the southern states and states bordering with Mexico.

Again, you probably won't be picked out of the line for a domestic flight but my husband was and asked if he is a USC and to show proof of legal
stay when he replied no.  We had the above mentioned items
and were ok. Things have changed. We aren't the only ones being picked out as others here have had the same experience.
It takes nothing to add the few papers when traveling domestically so why not just do it. Border patrol / IO's randomly pick people out on
DOMESTIC FLIGHTS at some airports.

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

AOS Interview letter received Aug 12, 2016

Second Biometrics appointment letters received for EAD and AOS on Aug 15, 2016 for Aug 17 ( 2 day notice).

Second Biometrics completed Aug 17, 2016

Third Biometrics appointment letter received Aug 19, 2016 for Sept. 1, 2016. WTH ?!

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

I wonder why they were so rude and snatched you and your husband out of line. Did they did that to others as well?
