Ah I see! Yea I mean it makes no sense.. but at this point I don't expect any sense from the system at all ... just waiting for the next thing to do and the next thing to do:.. the craziest thing is that we have been sooooo organized which means this process has ONLY taken us a year ... which seems to be so fast compared to some cases ... so trying to consider myself lucky but still - sucks to spend the first year of my marriage away from my husband. At least everyone is supportive here

Why would someone try to skip the last formality after a year of paperwork and fees?

People get nervous/anxious and/or want to be together sooner, so they try to skirt around (or even outright break) the rules. I'm not saying it's common by any means, but it's certainly been done so it's something CBP still looks for. Visiting with an ESTA is usually a fairly (relatively) hassle-free process, though.

The other thing that does tend to come up is frequent visits during the process, leaving a potential suspicion of using the VWP to live in the US.

A wet signature for the I-864 is expected. All supporting documents can be printouts/copies. I've certainly seen I-864s accepted with a printout, but it is possible for them to ask for a wet signature. Keep in mind this is a legally binding contract...if it came to court to enforce it, having an original on file would be important (a la "I signed one originally but decided not to go through with it so I took the form back.").

Yes, it would have resulted in a checklist, which is taking ~6-11 weeks on average. That said, NVC only briefly reviews the I-864....the CO makes the final call on the public charge consideration (which can be above the 125% poverty level...that's just a bare minimum required).

 

Good luck! You'll get it sorted out eventually....it's just a few snags along the line until you get to spend the rest of your lives together.
