N-400 and I-751 combo pending

This is a quote from a husband of a 2016 July CSC 751 filer, she is going to be naturalized in 2 weeks, and she has never gotten her 751 approval like many reported cases.

She had her citizenship interview on 12/20 and it was a double interview where the officer asked her questions about our relationship alongside the normal citizenship topics (even though I came with just in case, I was not involved in the interviews at all). Because of this, no 10-year green card was ever issued and the immigration officer approved the ROC at the same time as approving her N-400. We're done with this stuff once and for all. 

It looks like this is probably going to happen to the majority of people with 400 and 751 pending at the same time.

Ha. I figured this would start happening. Personally, I'd ask for my 751 filing fee back if that's the case.

But USCIS is not like Best Buy where you can ask your money back, I guess we are just paying for the approval, INA requires it, but USCIS does whatever they want.

Yes yes,  I am aware, I lived through a whole lot of USCIS nonsense, at every step of this process. But there is a point to be made that if you never receive that which you have paid for, USCIS should maybe be accountable. Just as they shoild have been when TSC was averaging 210 days for NOA2 and CSC was averaging 21. Or their continued "lost medicals" snafu. But of course we all know that USCIS isn't accountable for anything so here we are, shelling out a whole lot of cash for work they won't perform.

Is the government accountable for anything? State or Federal? Look at this way...what is their incentive to do better, streamline the process etc?? NONE!! They don't get fired, we cannot as the people (USC) fire them..so we pay more for less services...its socialism at its finest...

I've had success at the state level gettinga DMV employee in trouble (not fired, yet) for refusing to accept my husband's green card as proof of legal presence.  I know that USCIS has no accountability but it doesn't hurt to bring it up, repeatedly, and make them deal with it. During the whole TSC backlog, we successfully got them to transfer the workload to CSC, and they had a stakeholders conference call about their timeline reporting as a result of us, and the immigration lawyer community's constant complaints about their fudging/lying about the "official" timelines that resulted in some notable changes (if not improvements). At a bare minimum, start a complaint in the right place and make it someone's pain in the butt job to formally answer it. I don't expect to see the money but I'm fine with forcing someone to recognize the problem rather than just taking it silently, happy that I'll eventually get my end goal. to each their own.

USCIS should be held accountable of course, but they were given so much power that they can literally do whatever they want. Especially under Trump's administration, now they are even trying to go after naturalized citizen by denaturalizing a citizen for the first time. Do not think it applies to us though, but it sure is scary.

The problem is we don't have leadership that holds USCIS accountable. My lawyer and among many other legal experts say there is basically nothing we can do for any applications as long as they adjudicate in 2 years, if you do not hear anything from them in 2 years for any application, you can file a class action lawsuit, and it will be expensive and a messy legal battle. I do not think it is going to happen to us, but it surely is frustrating in this CSC backlogged immigration year.

Not quite as simple as that......that specific operation is to do with people making material misrepresentations, concealing previous identities and orders of removal, reliant on the fingerprint database back then being on paper, instead of digital.

In other words, fraud - and the citizenship(s) should never have been granted in the first place.

 

Nothing to do with trump either (despite him being a **** ) - it was discovered in 2008 and has been an ingoing investigation since.

 

 

 

However, I do agree with you that USCIS is an utter disgrace and needs to be held acountable

Yes, but the fact is this is the first case of denaturalization is a bit alarming to me. Don't mean to be paranoid, but they could just find some past discrepancies or something on your application form and accuse you of not giving correct information. Trump has started to incrementally make the family based immigration more difficult. This is actually a good time to start the immigration process before Trump does so much damage to our immigration system(by making it harsh and difficult)as well. He is clearly anti immigration and we just have to be cautious. USCIS should be reformed, but certainly it won't be reformed for good under this crazy administration. However, I do realize it is important to give the most accurate and 100 truthful information under oath for immigration purposes. I am not condoning the fraudulent nature of the denaturalized, but we have to just watch our shoulders under the Trump White House though, but since we are already in process, whatever Trump does probably won't affect us, and that is a good thing. Yes, the investigation about this case was ongoing, but Trump administration probably made it easier to denaturalize this Indian citizen. It may or may not have anything to do with Trump

Two more days, I will hit the 6 month mark since I applied for 400. Got a letter last week saying they would adjudicate my 751 and 400 at the same time like I predicted. 751 has been pending for over 18 months. I guess 4 more to 5 more months and this mess will be all over. Just been patiently waiting for that text message saying "We have scheduled your interview..".
