Timeline

Can anyone who has gone through the Manila interview process give me more insight of what the COs look for on the Petitioners I-134 Affidavit. Is it annual gross or net gross? I am self employed, which is where a majority of my income is from, but I do have another job that I have had for a year but it is p/t bc of my main line of work. If they go by gross income, I exceed the 125% but if they look at net gross I am slightly below due to expense deductions. I would greatly appreciate feedback!:)

You are F-1, family based ?  The I-864 is used with immigrant visas.  Your time line states K-1, that is the I-134.  :unsure:  You are a USC? 

 

It is GROSS income (line 22 of the 1040) , for the 125% requirements.  Follow the embassy instructions letter on requested documents, not the I-134 instructions.

Im applying for K-1 fiance visa, neither one of us have children so the petition is for 2. Since my taxes will b based on self employment, I read they look for net gross instead of gross.

The embassy is requesting I-134 paper work again?  

I read a Freedom Of Information Act release from USCIS a couple years ago and they said it was a non binding document, and I was told some CO at USEM were telling people that it wasn't really needed.

 

Just when you think you have TDS eradicate,  a new case shows up.

USEM can/does at times ask for financial information. It's been about 2 years now that they have not asked for that information on a consistent basis, BUT some have been asked and if not provided then the possibility exist the the applicant received a 221g asking for this information. Without it the visa is not approved and will not approve until it's received. 2 plus week set back.   it's better it's better to have this information the not have it at the time of the interview.

Income is based on GROSS INCOME as listed on line 22 of the 1040 tax form.     (anyone hear an echo?)

 

The I-134 is still listed in the embassy instructions letter, whether the embassy asks for this document or not is not consistent, being prepared is always good.

Look at line 22 of the 1040.. that is your TOTAL income and that is what the embassy (and USCIS for AOS) looks at.

It is interesting that USEM does that still.

 

 That was always a big hurdle for many.   In reality the financial support it just an imaginary barrier for most.  

Just when you think you have TDS eradicate,  a new case shows up.
