Timeline

After my wife is naturalized she brings up divorce and states that I should be the plaintiff. She is a widow, according to every document I have seen. How would it be possible to fake all that? No infedelity, no abuse... nothing. She even openly admits that she is being too harsh towards me.

Your post is not really clear. 

 

Are you saying that your wife was a widow before you were married or is she presenting herself as a widow now? 

 

Also sometime being the plaintiff has it's perk. Personally I'd make her file herself as she's the one that wants the divorce.

 

If you feel she's been planing this all along (it definitely could have been) and you were blindsided just let it go. Not much you can do now.

I saw you post in a another thread about this but am a little confused. Obviously, if your wife claimed to be a widow and is not the she lied. But the question is whether or not her ex husband is still alive. If so, and there was no annulment (there is no divorce in Philippines) then that is a huge issue. If she lied about being a widow because she knew it is not easy to get an annulment in the PHL then that is obvious fraud.

 

Or is it a simple case of she lied about being a widow and was never married?

 

If she has gained citizenship and is now wanting a divorce out of nowhere like you mentioned in the other theread, then there are some serious realities you will have to come to now.

if she has been married and just told u, report her as bigamist

depending on the state this can be quite serious and i doubt she will want jail time

you don't need to divorce

in case she gets away with this i would definetly let ICE know so she can't bring in  another husband or marry again another unsuspecting man

All that aside there are still some issues at hand. First being that she wants a divorce. You can love someone but you can't force them to be with you. Also, you did not answer the questions about her claiming to be a widow.

On all USCIS documents we have submitted, they all ask about previous marriages. How can all of it be faked to include a foreign death certificate and grave marker with his name engraved?

I understand you're in shock and your world is crumbling around you but in order for you to get answers you have to try and call down a little and answer the questions.

 

All immigration papers list your wife as a widow, you now believe that to be untrue - why?

 

I'm so sorry you are going through what is obviously an awful experience but the clearer you answer questions and state facts the better people can answer your questions or point you in the right direction for help.

Documents can be faked and forged.

You don't need a death certificate to hire someone to make a gravestone.

Basically if a person has the right resources (money), it can be done.

 

Why do you think she lied about being a widow? Did she come clean?

Plus documentation in PI is only recently starting to have decent standards. Changing a name, birthdate, marriage status, etc. was quite easily (and probably isn't too hard still). If it wasn't ever recorded at a major records office, it basically only exists (or not) on your word.
