hold o1, prepare i 140, if 140 approved, if I back to my home country submit i-260, can i go to embassy to get a new o1 visa ?

Right now I just get o1 approved, my husband hold f1 in usa.

I plan to entry usa by this month. then my husband change status to O3.

 

I still have some work still have not been finish in my home country.

I have to back to my home country in 50 days. I plan to submit i 140 in one month with pp, I think it could be approved in 2 weeks.

If i submit i-260 in my home country, can I still go to embassy to get o1 visa renew?

 

i-260 in my home country may take half year for the interview. I still have some work need to finish during this time. but my husband still hold O3 in US. can we submit 260 in my home country and i-485 in USA in the same time?

If we submit in the same time. there will be a issue, o1 holder's i-260 interview will be scheduled in half year, but my husband hold O3, the i-485 interview will be scheduled in 4 month.

the derivative applicant will be interviewed before principal applicant.

 

If I go to do i-260 interview at first, then my husband go to submit i-485.

when my i-260 approved, my husband's o3 visa will be expired in the same time. he will be out of status.

 

Could you please let me know what should we do?
