Filed I130 didn't provide proof of bonafide marriage

Hello I filled a petition for alien realative for my husband living outside of the US I only provided them with the documents they request on uscis website. I did not include wedding pictures or anything to show a bonafide marriage will our petition be denied?

Highly unlikely your petition will be denied; if an adjudicator needs more from you, they will send you a Request for Evidence (RFE).  If you receive one of those, it will specifically state what they want.

July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)

Thank you so much for your help we will just wait to see if we get a RFE and in the mean time I will be collecting evidence.

We too....We just attached marriage certificate, passport copies and birth certificate.......if they want more evidence they will ask for me....we have been collecting all the evidences now....like chats, phone calls, gifts exchanged, the trips we have done etc etc......

On another forum I visit, the posters regularly advise people that evidence of bona fide marriage is not needed. Their interpretation of the I-130 instructions is that this is not necessary as the instructions say "you should submit one or more of the following..." and the stance taken is that "should" is not the same as "must". Whilst I have seen approvals where no further evidence other than the standard required documents were provided, these tend to be people who are filing through the DCF method in London. And the very fact that they are eligible to file this way is strong evidence of a bona fide marriage (because they are living together in the U.K.). 

 

For those of us living apart, and those going through a difficult embassy (such as you are, OP) and for those of us with red flags (such as we had) then this is your chance to throw everything you've got at your case as this is the only way to guarantee that the officer who interviews you or your spouse at the embassy has the evidence in front of him. We sent over 300 pages because my husband has a felony and he was previously denied a visa for the U.K. (my country) so we had to give it everything we could. 

 

Did USCIS Nebraska read all 300 pages we sent? I don't know. Did we send too much? Probably. Did the interviewing officer read everything in the file? I think so (since he made reference to some specifics that were included). Would I have been approved without all that extra evidence? Possibly. The only thing that matters to me is that my visa was approved and we are finally living together. I would have sent 300000 pages to get this outcome.

Yes we are doing the same if we get a request for evidence it will take more time but hopefully not too long it's just a waiting game right now best of luck to you! Thank you for your feedback 😊

Thank you for taking the time to comment on my post it's much appreciated! It's good to hear bonafide marriage documents are not a requirement I was worried but we are working on collecting more evidence now we plan to have call logs, plane ticket, pictures from my trip & wedding if possible proof of my name change. I would like to have affidavit from his family and mine as well and I've also read wire transfers are good proof too. I think it's the best way to do it that you added so many pages it's better to be prepared and that shows the officer you are trying I'm trying to explain that to my husband do you know if affidavit from family really helps?

OP, you’re from Pakistan, you should have included bona fida evidence such as passport stamps/boarding passes, chat logs, emails, pictures etc with your I-130. 

 

You’ll have to add them at NVC now, although it’s not certain that the CO will review them. Some COs only review what’s in the I-130 package.
