IS IT OK TO MAIL N-400 WITH I-175 STILL PENDING AND ALSO WITHOUT A STATUS INFORMATION LETTER FROM THE SELECTIVE SERVICE ???

Hello there Guys. so i actually have two questions bothering me and need answers. All suggestions will be appreciated.

 

Firstly, Is it ok to apply for N-400 while your I-175 is pending ? I have been in the US for three years now and its  been over a year since i applied to remove my conditional residency.Its actually pending. I recently received a letter from USCIS that, my file is located on their PRE- ADJUDICATIVE UNIT. Do anybody knows what that mean. From the various articles i have read, most are saying the Pre-Adudcative mean my case has been approved in a way. would be glad to know what this actually mean and also if its good to actually file for the n400 since i am eligible .

 

 

Secondly, i turned 27 before coming to the US so certainly i can't apply for a selective service. In the N400 it ask if you did register ( NO  ) was the answer.  I was wondering if i can actually mail my N400 with out the status letter . Clearly the USCIS know i was 27 when i entered the country. My question is , do i really need the status letter at all cost ? I already requested for that letter but its been over a month and nothing from them. Tried calling but lady said they kinda busy at moment and as soon as it gets to my turn, they will mail me. CAN i mail my N400. Only thing I'm waiting on is this letter . Thanks Guys

I can only help you with the SS letter issue. You were over the age of selective service registration requirements. Worst of the worst, USCIS asks for the exemption letter you are waiting on. If you really feel you need that exemption letter now, have your local congressional representative help expedite if for you. They have a caseworker in every office who helps with those things, so give them a call.

 

So yes you could mail it without it, you might get an RFE if someone at USCIS doesn't common sense check as to why you marked NO, but it is easily fixable with that exemption letter. It is a personal choice to wait or not concerning the selective service.

1)First Master Calendar Hearing: Sept. 9, 2015-Continued based on pending i-130, new court date in 6mo.

Congressional Inquiry: Dec 8. 2015

***i-130 APPROVED WITHOUT INTERVIEW: Dec. 21, 2015** :dancing:

2)Second Master Hearing: March 9, 2016- Removal proceedings terminated w/o prejudice based on approved i-130!! Remanded to USCIS to begin AOS process :dance:

(AOS AFTER TERMINATION)

Filed AOS packet: March 16, 2016.

NOA1: March 21, 2016.

Biometrics: April 20, 2016.

RFE Initial evidence: April 21, 2016 for birth cert/translation and Q1/B1 i94s

RFE response received: May 10, 2016.

EAD approval: May 25, 2016- Card arrived at attorney's office! Could not pick up until May 30 because we were at Disney World again :):D

Notice of missing medical exam: July 2016 (Done on purpose to avoid expiration, we will bring it to the interview as stated in notice)

Inquiry about case status: Sept 2016- Case pending interview at local office.

Inquiry about case status again: Oct. 2016- Due to factors not related to your case, anticipate a delay in processing

Infopass #1 at local office: Dec. 19, 2016- Case pending background/security checks, advised when to renew EAD #2

Text notification, new card being produced: March 29, 2017!!!

Yes, if you are eligible to file for the N400 now, you are allowed to file it while the i-751 is still pending.

 

If they approve the ROC before your N400 interview, then it's ok.  If they don't, you'll do a joint I751/N400 interview, as others have.

Filing for the N400 while the other application is pending sometimes forces USCIS to adjudicate the i-751 more swiftly (kind of like getting it out of the way first).
