Getting Married But Have Received The Receipt Notice Already for the K-1 Visa

Timeline

Hello, we have submitted all the requirements for the Fiance Visa last July 2017. We have received the Receipt Notice after 2 weeks.

 

I am currently in the Middle East for work. This is where we met, btw. But he had to go back to the US after one year of dating. 

 

Anyway, I will be back in the Philippines for vacation on December. My fiance told me that he wants to get married in the Philippines while I'm on vacation. 

 

And of course, I want that because it's been months since we last saw each other.

 

Has anyone done this? Can we just change status of our application? From Fiance to Spouse Visa? And how long would it take for it to be processed and approved?

You can't just change status. 

1. Withdraw the k1 petition. 

2. File the cr1 spouse visa petition. New fee of course. 

3. The process takes about 12 months before you can move to the USA. 

K1

29.11.2013 - NoA1

06.02.2014 - NoA2

01.04.2014 - Interview. 

AoS

03.2015 - AoS started.

09.2015 - Green Card received.  

RoC

24.07.2017 - NoA1.

01.08.2018 - RoC approved.

Oh no. So it means we will have to wait longer if we decided to get married? So the best option is for us to wait until our Fiance Visa has been approved then?

@S_Flores it is better to continue your k1 application since it only takes roughly around 7 months. I am also from the philippines and is currently working here in UAE. My case took 6 months total. I will have my interview on october 9.

@S_Flores Wait are you going back to the philippines for your interview or you will have it here in UAE?

If you guys decided to continue with the K-1 visa application, please do not get married just yet. K-1 is for you to get married upon your entry into the US, not outside.

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.
