I-130 petition for parent of a US citizen over 21

So I was wondering.... my father is a filipino citizen but he is an OFW(overseas filipino worker) residing in another country(works in Saudi arabia). Once his petition gets approved which US embassy will he have to go to? The philippines or Saudi? This is all jusg so confusing. Does anyone know how that works. Would he have to return to the philippines once he has an interview and when he begins dealing with the embassy?

Definitely the US Embassy in Manila. He can return to the Philippines before his scheduled interview. How is he gonna collect his birth certificates and other documents from Saudi without going back to the Philippines right away though?

Good point, but the birth certificates and all his docs aren't really an issue to obtain from afar jusr as long as he gives authorization letters to access his docs. Do you happen to know though if its possible to do the interview in the current country he's in or does he absolutely have to return?

Best thing you can do to confirm that he can have his interview at Saudi if through calling NVC and asking them directly. I've seen an article that says it's possible (look for the thread below). However, it could have a huge delay since they have to transfer documents or whatnots to a different consulate. NVC already takes a long time to process IV cases, what more if you're still gonna have to transfer to a different consulate.

Oh and another question its about the affidavit of support. If im currently not employed and have never filed taxes and i bring in a joint sponser who fitd the guideline of 125% above poverty guideline will that do? I heard that if that were the case i would still have to fill out an affidavit of support but i would just have to write a cover letter specifying why I wasnt able to fill out the form. Anyone know how true that is?

Have you never been employed? You have to be current on your taxes or explain why you didn't have to file.

He should interview wherever he currently has legal residence. Traveling abroad just to do a medical and interview may look strange. That said, if he intends to exit KSA and reside in the Philippines until the interview, that's fine...that's what my fiancee did. Her residence was in Philippines at the time of the interview (and she was asked 3 times that she no longer lives in KSA during the interview).

 

If he does interview in USEM, I would suggest getting the police clearances before exit. While the reciprocity schedule states that it is not required if you no longer have residence in KSA, it's very difficult to impossible to ever get one after you exit as a non-Saudi national. So having one even just in case you ever need one in the future is probably for the best.

 

If the case is sent to KSA but you need to change it later, that's possible too. Just contact USEM and have them request to transfer the case to Manila.
