having problem with my k1 status

Please help!

i got my k1 visa after my fiance filed for me and i traveled to be with her, we started having issues when i got there cos she's so much into her ex and i can't cope with that,all she told me was that she got kids for him,so i see the marriage is not working out so i traveled back to my country in order to avoid breaking any immigration rules and regulations,after 5months i tried to get myself a non immigrant visa to attend my Aunt's 60th birthday and i was denied the visa with the consular stating my status is still immigrants and i cannot be issued a non immigrant visa,please assist me on what to do. How do i change my status ?

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

You say your marriage was not working so I assume you and her got married within the 90 days, correct?

 

The next important question is did you file adjustment of status after marriage (did you receive a green card)?

No,we didn't get married and we have been preparing for our wedding before i realized getting married is not just what i want but staying happy in the marriage,so i decided to leave before the 90days

Sorry there is no status for you to adjust from. Your K1 was voided the day you arrived in US. A visitor visa will not be issued to you. Sorry At least you did leave before the 90 days.
But any future visitor visas probably will be denied. Maybe after some time it's possible since they will see you left before the 90 days which is in your favor.

For the immediate future, getting a non-immigrant visa is highly unlikely. They probably assume you want to return and reconcile with the petitioner and stay.

 

You did the right thing by not rushing into something you weren't ready for and for not overstaying. However there are still consequences and having to wait some time before they will consider you not to have immigrant intent is one of them...you need strong ties to return home, which is hard to prove when you only recently were (presumably) ready to leave that all behind to come to the US with the intent to stay. It takes time to build up strong ties.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

you lost your K1 visa and it's almost no way to come back to US soon unless you get the new K1 visa with the same person or somebody else or you marry abroad and get the spouse visa.

What your fiancee is saying? Is she still willing to do another K1 visa or to marry you in your country and bring you here again?

One K1 visa it's a big effort for the USC, usually we are not willing to do even the 2nd one (I did though) and if she loves you, maybe she does but it's no guarantee you will stay, you already showed how unstable and not serious about your fiancee you are and it's very possible it won't work again. Your fiancee needs to think very well if she is still willing to bring you to US again

He probably left so easy because it did not cost him anything to come on K1 visa, usually USC thinks Nigerians are poor and we pay for everything and help with money, then a Nigerian (my ex is a Nigerian also) thinks it was easy one K1 visa, he can waste it and ask for another one, it happened to me and then the 3rd one, it won't happen to me the 3rd one, no way.

Anyway, even the first K1 visa is very serious and if you go back to your country divorced or not married or still married but wasting all this so long waiting opportunity and so much money, better think well. To me the topic starter didn't take it serious (his marriage) and now wants to get back not his fiancee but America, the aunt birthday visa or anything but back to America

2.  B2 visa is almost certainly all but impossible.

3.  Teach your Aunt how to video chat from the party.
