IR-2 visa (biological child of USC) June 2017 filers - any sub forums?

Hi all.

 

I am just trying to find subforum/topics created already for my case - natural born USC petitioning for her biological child - I-130.

 

Received NOA1 in June 2017. 

 

1. Just checking if there are others in the same boat. 

 

2. Also, additional question, would the child, upon receiving the Immigrant Visa, and the entry at POE, be considered as a USC immediately? Even if the child (legally is still in the care of BOTH USC and LPR parents), did not enter the POE with the USC parent, only with the LPR parent (and staying in the USA with that LPR parent of course)? it is just that the USC parent cannot go to the USA just yet due to work constrain.

In my understanding your child need not be filed as an Alien Relative but rather will inherent the USC parent citizenship given all conditions are met. I need to find the link for that.

In my case, the condition to get automatic citizenship is not met (went through the requirements multiple times plus the local consular office explicitly stated of the ineligibility), hence the I-130 route :)

and then Medical (in my case, i get an exemption of Affidavit of support).

 

I think medical in Malaysia would cost me around RM600.

your timeline is very interesting, you had to do AOS but medical in Singapore? How old is your daughter? (why was she not included in your initial application though?) 

I kinda made the mistake of not including my child's in my initial application, hence had to petition for him now. And i got Nebraska, which i heard would usually take 9months to 1 year for approval before getting to NVC!! :(

AOS is the Affidavit of Support not Adjustment of Status. I'm not sure why you are exempted they actually ask for payment of that at NVC stage.

 

I was under CR1 when we file our case. We decided for me to come first before I'll bring my daughter here just for me to get adjusted with the life here so I could pretty much guide her once it's her time to be here. 

 

I was working in Singapore so I process everything there instead of going to Philippines. I got Texas for my daughter which is pretty much the same with Nebraska. Smh God's timing is perfect so I'll just think of that. I was for Potomac when I processed mine it was quick. My timeline was pretty quick. In all stages.

She is 13 yrs old and since I'm a spouse applying for immigrant visa she would need a separate application. Unlike K1 and K3 that can be included as derivatives.

Ah okay, VJ forum expanded AOS to be Adjustment of Status. Yeah, you were lucky with having to wait for 60 days for the Service Center stage!

I am not expecting anything till early next year, which i hope i would get something from NSC

For USC petitioning for biological child, the child, upon entry as a LPR would automatically be a citizen of USA (if certain conditions are met) - hence the fee is waived for children that meet this condition .  (stated in this link https://travel.state.gov/content/visas/en/immigrate/immigrant-process/documents/Step_4_Collect_Financial_Documents.html )

 

You do know for LPR petitioning for biological child, it would take 2 years for the visa to be issued right? (unless the USC partner is petitioning for the child) - unless i got my info wrong.

Yes you're right. She is a minor so her stepdad petition her as his child. So I'm just hoping she will be here in time for the next school year.
