Fiancee Pregnant With Twins - Possible to Expedite K1?

You are correct - it depends on states.  If I were in his shoes - I would still recommend her to stay where she is and have the babies.  The cost of having babies here are ridiculous.  My first was about 4K (vaginally birth - a bit complication - was considered as a high risk).  Then with my 2nd, no medications, no complications, vaginally birth and it was 8K! A whopping 4K increase within 5 years.  good thing, my insurance paid for them - I only had to pay the hospital stay fee with my 2nd.  My 1st baby, I already reached my deductible which was 1000 at that time.  If I give a birth in Canada - it will not cost me anything but I have to live there in order to get the health coverage.

I applied on september 2011 and got noa2 on january...visa interview april 3rd. If she is at least 3 months pregnant, that puts her due date sometime february- march. Is very unlikely  you will get her visa approved. My adviced would be just to be patient and make peaces with the fact she (most likely) will give birth abroad, which is not an issue for the babies in terms of immigration. Once they are born you can go to the US embassy there and register your babies...

Yeah this was why I was asking, since twin pregnancies pose a much higher risk. I thought it might count as an "emergency" situation for expediting the petition. There could potentially be 3 lives at risk. I understand normal pregnancy not being a reason to expedite.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I think that might be up to your employer or state law or something. I asked and it was a no-go.

23 Jan 2016: "Blizzard of the Century", wedding canceled/rescheduled (thank goodness we were legally married first or we'd have had a big problem!) :sleepy:

24 Jan 2016: Small "civil ceremony" with friends and family who were snowed in with us. December was a bit of a secret and people had traveled internationally and knew we *had* to get married that weekend, and our December legal marriage was nothing but signing a piece of paper at our priest's kitchen table, without any sort of vows etc so this was actually a very special (if not legally significant) day. 16 Apr 2016: Filed for AOS and EAD/AP (We delayed a bit-- no big rush, enjoying the USCIS break)

23 Apr 2016: Wedding! Finally! :luv:

K-1 Visa Timeline:

PLEASE NOTE. This timeline was during the period of time when TSC was working on I-129fs and had a huge backlog. The average processing time was 210+ days. This is in no way predictive of your own timeline if you filed during or after April 2015, unless CSC develops a backlog. A backlog is anything above the 5-month goal time listed on USCIS's site

Potential future complications don't qualify. If there are signs of a serious medical issue (especially to the mother) then there may be a case to be made. But an increased risk just doesn't fall in the expedite criteria.

I'm pregnant as well and from what I understand pregnancy is no reason for the visa process to be expedited, and I definitely don't think you should expect preferential treatment. I know I'm certainly not expecting any because I'm pregnant. As people have pointed out to me, pregnancy proves intimacy not necessarily anything else. Although of course it doesn't hurt in regards to showing your desire to build a life together as a couple and we mentioned our pregnancy in a letter we wrote expanding on question 54 on the I-129F form. I have been advised on this site not to go overboard with my pregnancy in the relationship evidence and I think that was very good advice. Someone also mentioned that it would be unfair to couples who can't have/don't want kids (but then again life is unfair). 

 

You never know though, there was one user (forget her handle) who said that her process moved VERY quickly and she attributed it to her pregnancy. You might get a nice USCIS officer who sympathizes with your pregnant fiance's desire to be with the father of her children at the time of the birth. And yes, processing times seem to vary greatly and that probably depends on how straightforward your case is. If your fiance is from a high risk country (in terms of marriage fraud) then it will probably take a little longer and you might get an RFE (Request for more relationship evidence) which causes delay. If it's a simple straightforward case and your fiance comes from a country that is not considered high risk of a) marriage fraud or b) becoming a public charge then it might go as fast as 2 - 3 months! It has nothing to do with states. I has to do with your insurance provider, what is covered, the rate at which you are covered and if the physician as a plan participant. Of course there are co-pay's and deductibles to consider.

My advice to OP. Check with your employer if your fiance will be covered and how long it will take her to be covered. Can you do it immediately or will there be a wait or do you need to wait until you are married. If you find out you can get her on immediately then check with your insurance provider to find out what kind of coverage she will have once she is on the plan. The reason for doing this is in case she does get her visa while she is still able to travel. You will need to decide if it is better to have the delivery where she is or here in the US. You can't decide that without all of the facts and NO ONE here knows your employer or insurance providers policies.

 

As for expedite, I think you have your answer already.

I don't think so. I was pregnant and they did not care lol... i already had my baby girl and we are still waiting for our visa to be approved and he already had his interview... currently gathering docs for a 221g  they did ask my fiance questions about the baby like if he has met her already he said no because she was just born.. so i can't take my baby out of the country they saw baby pictures and asked how old she was.

At the risk of going slightly off topic, the US citizenship registration for the twins may be slightly more complex if they are born out of wedlock. See the "Birth Abroad Out-of-Wedlock to a U.S. Citizen Father" section in https://travel.state.gov/content/travel/en/legal-considerations/us-citizenship-laws-policies/citizenship-child-born-abroad.html. If that is a concern for the OP, I'd make an enquiry with the US embassy in Dublin.

It's not really more complicated. I'm in that situation and you just need to go to the US embassy where you want to register the birth and show the birth certificate with the father's name on it. Although, I live in Canada so the father will actually be present when we register her - I guess it might be a little trickier if he's absent? In that case you might need a notarized letter from the father acknowledging paternity or maybe even a paternity test??

 

But all the embassy in Canada requires is the birth certificate with the father's name on it.

I just mailed the petition on 9/1 and it arrived on the 3rd but I haven't received NOA1 yet. I will update it as the information becomes available.
