Timeline

I just lost a topic that took me an hour and a half to compile!  Will write in short now.

 

A friend, married for 2nd time, moved to US 2.5 months ago.  Serious abuse - mainly mental, verbal and emotional.  Also, her husband took a large amount from her USD130K and transfer was done to 3rd party.  Now they want to send her back.  I have spoken to her husband and he cites reasons such as my friend using Facebook once in a few days, being friendly (social!) to men, sleeping for more than 5 hours a day.

 

They clearly want her to leave now that they have her money.  We have spoken to two family lawyers now and will be difficult to prove that money was asked to be sent by husband.

 

She is unable to live there any more but is putting up with outright torture only for the sake of her daughter from previous marriage.  Her daughter is 9 and still in home country.  her visa stamped, but she has not travelled yet.

 

My friend cannot go back to home country with no money, she sold her home, emptied accounts.  She doesn't have any family as such.  She wants to stay in the US and I am willing to employ her.  Stupid on her personal front, but highly capable in her field hence easily employable.

 

However, she needs help with two critical questions

 

* Can she ROC eventually, if her husband divorces her now, less than 3 months after arriving.  She doesn't have any real evidence for VAWA, although neighbours are aware no one will give statements

* She worries if she leaves they can cancel daughter's visa as her daughter has not PoE yet.  Main reason for staying.  She wants to leave settle herself and get daughter to PoE in 2-3 months, however doesn't know if visa is cancellable.
