Juvenile record 35 yrs ago required to be disclosed?

Living in Ohio at the age of 14 or 15 I was charged as a juvenile for stealing a moped\scooter ....... is it required to enter on the I-129F Visa application? if it is not should i include it anyway? ....I am 50 years old now and I cant even really remember date I was charged or what the fine was

Can you get a criminal report on yourself?

 

You need to include it since you got charged. Not that it will affect your application at all. But not including it will certainly affect the application because bureaucrats live for those sort of things.

Thank you Coco.........My records were sealed so I have no idea how I can go about getting my criminal report as I have never had to retrieve them before

Were you given a desk ticket to appear in court?  If so, do you remember which courthouse---like roughly where it was located?

You have to request a court-certified record of the disposition in your case (now, it's been obviously destroyed/purged since it happened so long ago), or a court sealed certified letter stating the records no longer exist from the courthouse you attended.  This is a requirement, even though it happened long ago---I know how tough it is to get the paperwork, I'm in the same shoes as you for something almost 25 years ago that I disclosed way back on my i-485, but need it again for the N400.

Oh and that's another thing----when you do order the copies...MAKE SURE TO GET SEVERAL OF THEM!!!!  This is so important because if you do decide to pursue further immigration benefits down the road (like citizenship) you will need to submit this document at every single stage, even though they already have it in your file.

 

I didn't think about this when I had to send away for this in 2005 for a charge that occurred in 1993.  It was hard to get it back then.

 

In 2017, adding another 12 years to how long it's been, has been a struggle for me---2 months later I'm still trying my darndest to get my hands on it, and had to go above the individual court's head to even get my request started under processing.

I do know what court house it would be at....... Ugggggg......And I thought I was all done and set with completing I-129F application packet....I have been working on it for days!.....  I had hoped to get it mailed out on Monday.... Now I have to contact that old school court house in my home town it sounds like......this sounds like it going to take forever!......but I do thank you for the info

Just make sure you order at least 3 copies of the letter....trust me on this.  Don't make the same mistake I did and only order 1.

They will also want the to see the arrest report/record (which has of course also been destroyed since it happened long ago).  This document is a bit easier to get if you remember at least the basic info ---- what the actual charge was, the legal name you were using back then, what city it took place in.  That letter, you apply for  at city headquarters/main police station that had jurisdiction over where you were living at the time the arrest occurred.  They will simply send you a letter stating the records were destroyed on their letterhead.  

 

And yes, get several originals of those letters too.

Generally, juvie records are protected from being pulled for anything at all...except immigration purposes.

You have to disclose any arrest/criminal charge, juvenile or adult.

 

If you don't disclose it and show documentation, and then later they find out about it?  Hasta la vista, baby

Start by calling and maybe you can sent it to you by mail or something.

Most places let you do the request via online, fax, phone or paper mailing.  Check the website for the courthouse.

Mine, I had to get from another country----I phoned and requested it (sent them scanned info via email to prove who I was).

yup, you do. I had the same issue - i also didn't know that it was even on my record so my previous visas i answered no to the question. and got my visas fine.. it wasn't until we got a lawyer for our green card that i realized it still exists.. and i answered yes to the question. it wasn't an issue though. i just got my police certificate and the deeper information request (i didn't go to court or anything, i was 14 and my friend stole something from a store!(i didnt even participate so i was very annoyed and shocked it was even on there!)

I saw that you were approved. Congrats! I'm wondering if you ever did include the juvenile record on the 129F and if you had to disclose it?
