You can read through many of the threads in this sub-forum to get an idea of how difficult it is in terms of time and money. There have been successes but they seem very rare and only after having a very competent attorney involved and spending lots of time and money.

The situation sort of begs for a full search of other options, like finding a life together in another country that doesn't have the same restrictions. Good luck.

Marriage: 2014-02-23 - Colombia    ROC interview/completed: 2018-08-16 - Albuquerque
CR1 started : 2014-06-06           N400 started: 2018-04-24
CR1 completed/POE : 2015-07-13     N400 interview: 2018-08-16 - Albuquerque
ROC started : 2017-04-14 CSC     Oath ceremony: 2018-09-24 – Santa Fe

You should probably be a bit more specific about your circumstances. Surprisingly, there are some situations which won't fall in the AWA category. So, before getting worried over nothing, try to verify if it's indeed an issue. That's all we can say at this point without knowing the details of the actual criminal history.

Cheers

unfortunately it falls in AWA category:(

That was me.

There RSO who live abroad and There was out option if denied.

The waiting is painful and unless you have the means to travel and be together part ofnthe time.

The attorney/legal fees were only part of the monetary costs. There was the cost of maintaining a home here and overseas,  the cost of living for my wife,  the cost to travel overseas 4 times a year.

It is hard emotionally but you must be patient.

Why does it have to be the USA? If you just want to be together, have you considered moving to a country that would permit a RSO to live there?

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

Now a US citizen!

As far as I know it's fairly to extremely difficult to receive an AWA waiver but you really need a good attorney who is specialized in cases that fall under the Adam Walsh Act. The USC has to proof he is not a risk to you.

Just a question, does the AWA come into play when the couple are married and filing for a CR1? Can you get married and proceed that way? I am just trying to offer suggestions

Has your husband commit crimes or offenses against the Adam Walsh Act?

Yes AWA applies for married couples filing for a spousal visa.

Otherwise what would be the point of the law?  All would simply get married and bypass the Act all together.

Good luck to all.
