2nd time filing

Has anybody ever experienced filing fiance visa for the second time with the same person? Our first one was abt 2 years ago and we were denied cos he and the mother of his children were still good friends with each other, so they said we were not in a banafide relationship. Cos he wanted to bring the kids along and she agreed. (Ages 3& 5).

Do you have more evidence to overcome the denial? Have you two had more face to face time? I would say you would need a lot more evidence, this go round, to prove a bonafide relationship.

Our recent photos is proof that we are in a continuous relationship for 3 years should be enough to convince them that we are in a bonafde relationship.

Recent photos would indicate another trip seeing each other, right? I would include copies of boarding passes, passport stamps, etc. I-94 maybe. USCIS look at photos as secondary evidence, so send as much as you can that you two have had additional face time together.

Many here have done second K1's with the same beneficiary including myself.

As to photos being enough.....no. Photos are good but secondary evidence.
Frequent visits, hotel receipts, any kind of evidence that proves you were in the same place at the same time.

Ongoing chats, itemized phone logs (showing names,date called, length of calls), screen shots of conversation between you

and his family on skype plus photos of you together and you with his family.
Take out a small insurance policy with him as beneficiary, if he owns any land have him put it in your joint names. If possible have
him add you to his bank account.
If his ex has remarried have him get a copy of her marriage certificate.

Many secretly still have a wife/girlfriend back home, pretend they divorced or broke up and use a USC for a green card and
then divorce the USC and bring the wife/girlfriend and kids over.
I don't know how a mother can so easily just let her kids go without expecting to join them later.
This is what is in the mind of the consulate and the burden of proof that it is not so is on you both.
You have to take extraordinary measures to convince them this time or they will deny you again.
A more stable way is to go there, marry him and file a CR1 spousal visa and make several more visits until the interview.
Frontload the next petition with quality and varies relationship evidence, don't wait to do this at the embassy phase.
Once the interview is scheduled go over and be on the premises so they know you are there in support of his interview
and bring any new and ongoing evidence to the interview.
This is not as simple as filing again and sending photos.

Correct me if I am wrong,this is the second person you are petitioning for. Not that it's a problem, I don't think a second petition for an already denied k1 is the best idea.  Just  go and marry your partner and involved family and friends. With more evidence.  Good luck and you will get it this time.

Ok Im confused..... Your timeline says you were approved late November last year. Did they later decide to deny it? 

 

In any event, you would have to overcome the reason from the denial, as opposed to just submitting more photos. More visits and more evidence.

Actually yes, OP had a previous CR1 with another person, the refused K1 with her current fiance and now wants a second filing for
current fiance, is that correct OP ?

That's what I'm saying exactly. Maybe I'm wrong. If that is your case, you have to fight harder with more evidence like CR1 and family involvement

It will be difficult, you may want to live there for an extended time, marry there and then file a CR1.

What was the issue with the CR1, why was it denied or did he get approved and POE'd and then you divorced ?
What was the timeline on that marriage ? All relevant to your next filing.

I think the op divorced the CR1 after green card . So this is a new relationship. Correct me if I am wrong ..The embassy would try to protect you from potentials users. So you have to do a better job by proving ties. Spend more time together, marry your partner and involved family. But what woman would give her 3 and 5 year olds to live with a step mum in a far away land when she is still alive? except she has plans to join them later or you are in on the joke. You have to be careful. And please don't be offended. I just don't like my people being victims of my people. I know.a family in Baltimore,the guy planned  with his wife back home,they got divorced and he married USC. a year later his ex-wife came to the us lives in Baltimore has 2 kids already in less than 3 years for him and just waiting for him to divorce USC and remarries her and make her legal. So it's a tug of war here. And the embassy and USCIS see cases like this every day. God bless you.

This seems like a case that any Consular would look at and think "Fraud", maybe on your part or maybe that he is using you. The beneficiary has a 3 year old child, yet this is a 3 year relationship? Petitioner, recently used Immigration Privileges for another beneficiary, that ended in a quick divorce. Beneficiary wishes to bring two very small children with him US and the biological mother agrees. It look very suspcious, and to be honest, having worked in government offices for over ten years, before making a mistake, they will deny, or error on the side of caution.

 

I had to step back and look at my petition like a Consular not like an emotional "in-love" petitioner. I am ten years older than my fiance, I have children, he doesnt. Which may raise an eye. However my previous Husband (American), is ten years younger than me too. So I tried to provide lots evidence of a bonafide relationship, flights, boarding passes, passport stamps, hotel receipts and photos with me looking 20 something of course with him, friends, family, trip photos, all that stuff...

 

I went over the petition, is it legible, is it organized, is it detailed yet not overwhelming, is the required documents easy to access and not buried in a bunch of nonsense, does this look like a bonafide relationship on paper, what are the red flags, have you addressed any red flags, is there anything that would make me think the petitioner or beneficiary is making a fraudulent claim, or is the petition being used to evade any immigration rules or laws. Once I addressed everything, I mailed it in.

Make a list of everything you would/they would consider a red flag. Try to overcome it, some things you can overcome some things you can't. Correct what you can and build more proof of a bonafide relationship, more visits, definitely marry
