Hi everyone, goodmorning and happy Sunday.

 

I was doing a final review of my AOS application before i send it out this week, when I found out that the form i-485 has been updated. I had already filled the old one. Most questions on the new updated form i-485 is confusing. My question is, can I still submit the old form i-485, since on USCIS website, it states that there will be a grace of 60 day grace starting from June 26, 2017. Does this 60 day grace apply to people who are yet to submit their application or only for those who had already submited their application before June 26, 2017.

If it's one of the two forms listed as okay during the grace period yes it's fine

06/08/2016: I-129F Sent

06/16/2016: Check cashed

08/23/2016: Approval

09/09/2016: At the Stockholm Embassy

09/28/2016: Embassy received completed medical

09/29/2016: Interview date, APPROVAL 

10/14/2016: Visa ISSUED

10/17/2016: Visa received

12/22/2016: I-485, I-131, I-765 Sent

01/10/2017: Check cashed

02/03/2017: Biometrics completed

04/17/2017: Your case is ready to be scheduled for an interview

01/20/2018: I-485 Interview letter received

In general, most people will be just fine submitting the old documents. If they treat it anything like the I-129F update though, as the weeks go on, you will see more and more RFEs requesting the new form. I found the new form to be less confusing but more frustrating to reply to. My biggest issue is how they locked down what you can and can't type into a field. For example, Part 1, question 23.c asks Status of Form I-94, you can't enter K1 Visa (even though that is the listed status on the I-94) because they only allow letters and spaces. It is clear that the people coding the form had no clue what the contents of fields would be.

01/10/2017 - After travelling via the slowest route possible (likely via carrier pigeon) BKK Consulate receives packet

01/16/2017 - Packet 3 Instructions received 02/28/2017 - Packet 3 Instructions Completed

03/05/2017 - Packet 4 received (now the fun begins) --> 03/29/2017 - Interview disappears from the schedule on the embassy website -->03/30/2017 - She goes to her interview, is told they need to verify her documents since she is Vietnamese interviewing in Thailand, receives a 221G with 'Verification of Viet documents' as the reason. Gave back her passport.-->03/31/2017-04/04/2017 - Case is being continuously touched. We suspect that our case was approved at this point but they didn't have her passport. --> 04/10/2017 (10 days after interview) - Email emabssy to inquire about updates and if there was anything we could do to move things forward. (3h later) - She is told that she is approved and to expect her passport soon (how when they don't have it in their posession?) After clarification, instructed to send our passport to them. Ship out passport in a rush to beat Songkran (which failed) --> 04/11/2017 - Passport at embassy according to Thai Post Office --> 04/17/2017 - Emailed to confirm they received the passport. They issued an evasive answer about Songkran backlog (they love evasive non-committal answers)--> 04/24/2017  Evening - Case changes from Immigrant Visa to Non-Immigrant Visa and a new case created date is given --? 04/25/2017 morning  (less than 12h later) - Case flies through Ready -->Admin Processing --> Issued

04/26/2017 - Checks mail, passport is there. No mention of it being mailed out. 

05/02/2017 - Arrives in the USA, without Issue

06/17/2017 - Marriage!

Yes you are right. That was one of the reasons why i used the word confusing. I think the best thing to do will be to type in the right answers to the questions and then leave a little space for the number (1). As in K1. Print it out and use a pen to write it down. 

 

Another question on the form that I do not understand is question Part 3, no1. Have you ever applied for an immigrant visa to obtain permanent resident status at a U.S. Embassy or U. S consulate abroad? Yes or No.

What do you think about the question pls. Does anyone know what should be answered and why?

I agree that it's weird how they don't allow you to type in K1, but on the form right before Part 1, it says "Type of print in black ink", so you will be safe writing in the parts in black ink with a pen.

 

Also, Athens, I believe that question in part 3 is if you have ever applied before for permanent residence.  If this is your first time, then the answer would be No.

that is also one of the confusing questions on the form. Maybe they meant Validity period of the approved petition. I left mine blank for now, though I am still thinking whether to submit the old form which I had already completed few days before the new one came out since there is 60 days grace.

Remember, this form is used to adjust status for a variety of petitions. Someone adjusting status from a K1 will not have a priority date. Someone abusing from one of the other immigrant visas covered by this document WILL have a priority date. If you check the NOA2 you received with your K1, you will see that the priority date field is left blank.

Check your NOA2 from the K1, my wife's alien number was right above her name in the Beneficiary slot.

I'm not entirely sure about the "Online account number" but you can sign up for an online profile on the USCIS website. Go to the homepage, click "Check your case status" and then sign up for an online profile. You can enter your reciept numbers once you receive them and keep up to date with your case online. You'll get your receipt numbers once you submit your paperwork to USCIS and get a response back (NOA 1) :)

Has anyone else had this problem:  

 

We applied for the K1 visa and submitted all the papers for it and during the interview, we received all the papers back.  We read in the instructions that we would get the originals back and now that we are trying to get all the papers in line to submit with the I-485, it looks like we did not get back the originals for the birth certificate and police records.

 

Is it supposed to be that way?  Since on their instructions, it says that we would be getting the originals back at the interview.
