executive order , partially effective for affected countries

Hi Guys , I would be really thankful if you could share your experiences or some information . My case as EB2-NIW was approved in USCIS and I had my interview on 7th June ,  the officer asked me questions about my research mostly , after the interview she handed me 221g blue form and asked me for more documents , again mostly about my research, I submitted it to them and they acknowledged receiving of it , my status check shows administrative processing till now and no update , since I am from affected countries of July 2017 executive order ( partially in effect ) , I would like to know if my case is affected and is my visa going to be issued? Is there any way to waive since I ma in last stage of my green card application ? Thank you for your assistance.

Hard to say entirely how this will affect you specifically as it is so new.

 

From what I have read if you do not currently have visa or anything in hand you may get swept up in the new vetting process.

 

As well as it seems it has been determined by the new guidelines that: "Grandparents, grandchildren, aunts, uncles, nieces, nephews, cousins, brothers-in-law and sisters-in-law, fiancees or other extended family members are not considered to be close relationships".

 

That is from what I have read. But you just may get held up in the vetting.

06/30/2016 : I-129F Packet Sent

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

Do you have a job offer from an university? I understand this is self-petition, but maybe you do.

 

My university sent an email saying that the Supreme Court exempted from the “Travel Ban” international students and scholars studying and working at U.S. universities based on their “bona fide relationship with a person or entity in the United States” -- entity being the university. 

 

So this would exempt you if you will work at a university. 

 

Otherwise, if you have no ties to the US, it will probably affect you, unfortunately. I am not sure if you can update the application but maybe you can try to get a position at a university.

 

My university also said the supreme court will be reviewing this again at the end of 2017/start of 2018. So it might change and it could be positive for your (or worse, who knows). They recommended everyone from the countries affected to try to avoid traveling if possible.

If you have an academic profile, at least try to get a visiting position. Then you can move to another position.
