Which PR status option - WORK or SPOUSE sponsorship?

Hi,

I'm a PR waiting for my marriage condition to be removed. Thank you for your help throughout my journey :)

A fellow Canadian friend of mine is in New York on a work visa and just got engaged to an American citizen. His work has offered to start the process of sponsoring him for his green card, and he's wondering which route would be faster/cheaper/easier - the work sponsorship or the IR-1 process? 

Thoughts?

If his company is offer to sponsor a visa it is kind of a no brainer. They cover the cost and process. He can save money and get married afterwards.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

(1) Green card through job. Company pays for it, but it can take longer to get the green card because there is a queue. The only people who don't have to wait for green cards are the people with PhDs. Usually people wait like 5 years. You should find out the wait for Canadians with his education level. The lawyers from the company should know. In addition to the wait for the green card, then you have to wait 5 years for USC.

 

The forms for the green card through your job are a pain. You have to put down your full work history with contact information for every job. And more forms, and more. I know because my boyfriend did this. There is a stage at the Labor Department in which they have to prove that they could not have hired a US citizen. 

 

(2) Your friend does not need a IR-1 visa. He is working legally in the US. He can marry and file for adjustment of status in the US. He can fill all the forms that you will find in the "Guides" above. Check this: http://www.visajourney.com/content/i130guide2 

 

The forms are much easier than the ones for a job based green card. Plus, you get the green card pretty soon because there is no wait and he can become a USC in 3 years. 

 

I'd go with (2). Marriage. I'd rather pay 1500 dollars and have my green card right away and then become a citizen in 3 years. If I want to move or whatever, I can come back later.
