Timeline

So my wife and I have sent our I-130 package off to the USCIS office in Rome.

 

Looking ahead at the Affidavit of Support form, specifically at the Income and Asset Information section, I have been unemployed here in Italy for quite some time, however, my job that I had in California (as a waiter/server) put me just under the HHS Poverty Guideline (with some of my assets, we're above it).

 

My question is, is that legit? Can I use my earning potential in the United States as income? Will this be a problem when we go for our interview?

 

I have proof of my income from the past years I worked in the US, as well as documentation of my assets. Work in Italy is just really hard to come by, especially since I didn't speak the language when I arrived here. What do you think? Looking at the form now I'm feeling a little uneasy about it...

I would look for a joint sponsor who is currently employed.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

What assets do you have? Assets have a few restrictions, you need to make sure whatever you plan to use fits the guidelines.

 

I think you will probably need a joint sponsor. Previously held jobs in the US do not count towards sponsorship. You need to show proof of income that will continue into the future, such as pay stubs from a currently held job.

No. You need a joint sponsor. 

 

You also need to move back to the U.S. and establish domicile or at least have a plan to demonstrate clear intent to move home ASAP.

Timeline

Even if you had a job in Italy, it wouldn't help. You need to show current income that will continue (the joint sponsor also must show this) OR solid assets that fit the guidelines.

 

You don't have to move back to the US to show proof of domicile. You can remain in Italy during the process, but you need to show intent to re-establish domicile. Proof includes: actively maintained bank accounts in the US, a mailing address in the US, actively maintained credit cards, voting records, state ID/driver's license which is not expired, etc. If you are struggling to gather such documents, then it might be a good idea to move back to get them. But if you have enough, you can stay in Italy if you want until you and your wife decided to move back after she gets her visa.

Usually not, sometimes we make people actually show that they have moved back. I had a petitioner send us pictures of herself holding up a copy of USA Today in front of her apartment in the Bronx once a week for 4 months. That was an extreme case - 75 year old petitioner acknowledged she hadn't been to the U.S. in 20 years. Had filed F3s for her 4 kids and their families (like 25 applicants in all). 

 

I'm sure she moved back to the Caribbean as soon as her kids had their green cards, oh well.
