Visa to sponsor your fiance

Hi, I just joined here to clear a few doubts.

I migrated to the US on H1B visa. I am working in South Dakota. All is going well other than the fact that I’m little bit worried about trump policies. I would like to settle down here but my boyfriend is still in Italy. We are planning to get married soon. He would like to come here and look for opportunities.

 

So my question is can I sponsor him with my H1B visa?  Do we have to get married outside the country? My employer has filed I-140 petition. Hopefully, I will get PR soon. Is this enough to bring your fiance to the US.


My next question is regarding my car. My car is registered in Europe, can I bring it to the US ? Is there any legal complications in that? I referred the website of a long distance moving company. They have mentioned that there are a few legal papers required. Can anyone tell me what all documents should we prepare? Looking forward to your replies.

On the car... It is a bit costly to bring the car to the US, but if you own it outright (not making payments) and if it meets US emissions and safety standards  you should be OK.  You should check website for information on those who are in the business of shipping cars.   You say "fiance"..   It is not possible for a permanent resident to sponsor a fiance. If you get married, you can file I-130 to petition him as your husband, although the process for permanent residents takes quite a bit longer than it does for citizens.  If you are married and have an H1B, your spouse can apply for an H4 visa.   My understanding is the fastest way would be to get married while still on H1B and filing for H4.

Does OP even have a green card? He said he came here on the work visa. No green card, no I-130.  If OP has a green card, the process of sponsoring the spouse takes about 2 years.

 

Nothing can be done until you're married.

What category i140; eb1, eb2, or eb3?  And what's the PD? 

You can petition him for an H4 only if married, not as a boyfriend.

Once you have proof of the marriage, an H4 does not take long to process.  Requires proof of marriage and proof that the primary's H1 status is current.  However -- very important point for you to consider.  H4s are not automatically authorized to work in the US, so he would not be able to pursue opportunities unless he applied for an EAD and was approved to work by USCIS. It will take several months, at least, for approval.

 

Most European cars do not meet US emission standards, so be sure yours does before you make shipping arrangements.  Shipping a car internationally can be pretty expensive --  several thousand dollars for the shipping and all of the paperwork.
