so we just got our RFE in the mail. We've only sent form 1040, and from there we thought he was making enough since he's making around $27,000 per year. But from the letter they sent, they're saying that it's not meeting the requirement? Does this mean we need to add a sponsor then?

A tax form 1040 alone isnt enough. Send a w2, 2-4 paycheck stubs, and an official tax transcript.

 

Also check the poverty guidelines for your household just to be sure :) if you're below that, you need a co sponsor.

ICE home visit, schedule time to go to DHS office and NTA issued, date TBD, was not detained and released on own recognizance within an hour: January, 2015.

Transfer to CSC to balance workloads: August 2015

1)First Master Calendar Hearing: Sept. 9, 2015-Continued based on pending i-130, new court date in 6mo.

Congressional Inquiry: Dec 8. 2015

***i-130 APPROVED WITHOUT INTERVIEW: Dec. 21, 2015** :dancing:

2)Second Master Hearing: March 9, 2016- Removal proceedings terminated w/o prejudice based on approved i-130!! Remanded to USCIS to begin AOS process :dance:

Filed AOS packet: March 16, 2016.

NOA1: March 21, 2016.

Biometrics: April 20, 2016.

RFE Initial evidence: April 21, 2016 for birth cert/translation and Q1/B1 i94s

RFE response received: May 10, 2016.

EAD approval: May 25, 2016- Card arrived at attorney's office! Could not pick up until May 30 because we were at Disney World again :):D

Notice of missing medical exam: July 2016 (Done on purpose to avoid expiration, we will bring it to the interview as stated in notice)

Inquiry about case status: Sept 2016- Case pending interview at local office.

Inquiry about case status again: Oct. 2016- Due to factors not related to your case, anticipate a delay in processing

It says in the letter that there is no proof of the income you stated. Which is true. A 1040 is simply the form YOU fill out. You could put on a 1040 that you make $500,000. That does not mean it is true. And it does not mean IRS has accepted it. That is why you send W2's with it. A W-2 is proof from your employer of you earnings. Transcripts are documented tax filings by the IRS about you.

 

Simply send what they requested.

it's not only the copy of the tax, you needed to send proof to back up the copy

 

as said, w2s, paystubs, employment letter if possible, a tax transcript is better

You could go ahead and send in the Transcripts W2 etc and see if that is accepted.. or you could arrange for a joint sponsor if possible as well, submit all their documents and cover all bases!! .... Depends on how easy it is to locate a joint sponsor.

It doesn't necessarily mean you need a co-sponsor. It means that since you didn't submit the appropriate evidence of income, they can't verify that you meet the minimum. It may be that they end up saying you are below the minimum, but right now that judgment is based upon the fact you haven't proven to USCIS that you have any income.

I was able to meet that requirment a few years back with the 1040 from turbo tax and my w2s. getting tax transcripts is fairly easy from the irs takes about 10 minutes after you gather all the info. and since this is an rfe I would recommend overloading it to make sure you pass since if they are not satisfied they can either send a second rfe or deny you.

The 1040 is useless without W2's to back it up.

Ideally, you want to send:

Tax Transcript
OR
1040 with corresponding W2's

AND

Pay stubs for a few months
Employer letter
Any relevant pay information like contract, yearly raise schedule, etc.

Depends when and how they filed. My 2016 transcript has been available since the start of February. I'm assuming OP filed a while ago given they submitted the 1040s with the initial AOS forms and got an RFE already, Normally, it takes 2-4 weeks for e-file, and up to 6 weeks for paper filing. If you owed money, then the timeline is mid-May OR a week after you pay the outstanding tax owed. OR, if you filed via paper and had an outstanding balance, then it's the mid-June timeframe.

Yep, you need to send proof that you got paid what you say you got paid. I'm self-employed, and when I filed, I sent in copies of every invoice over the last year to prove my income was real, plus bank statements, plus copies of 1099 forms from clients. You have to prove it as though it was a court case, think of it that way...show them evidence that you really do earn what you say you do.
