Hello eveyone,

I know you must be tired for answering this question a lot so I will do my best to make it fast. I have known the woman I love for 5 years, she is Filipino. She is coming here in about two weeks We want to get married but I am not sure which process will be better for us.

1) Get engaged while she is here and apply for the K1

2) Get married while here and apply for something else.

I do not make a lot of money and I would be able to pay for things...just would have to save up and pay in spurts. Which one is better? Thank you any and all help.

thank you EmilyW, I do not feel like it is fraud... she does not really need me to pay for things she does that all her own. I just was not sure about which one would be better. Her and I have talked and we both know she will have to leave and go back to the Philippines while the application process is going on. Thank you again

If I had to do this all over again, I would definitely marry and not bring her  over as a k1.

If k1, the you have to do the aos and wait, get a ss number, get a temp driver license, the after aos, do a temp green card, get a real driver license, then go with the green card.

 

If bringing over married, there is a bit more wait time, but when she comes over she will already have a ss number and have a green card.

 

When El got her k1 visa at 3pm, I had her on a plane at 1130pm.

No that is not what Emily meant by fraud. It is fraud if you plan on using a separate visa other than a spousal or fiance visa to come and get married and stay. So using a visitor visa to enter the US to get married and adjust status is fraud.

Nope. That method is fraud.

It is fine if you get married while she is here.  She just has to go back to her country afterwards and wait for the process.  If you want to do that, it is fine.

The problem you - and her - face is with being truthful when entering the US if there is an intent to marry, even if the goal is to go back to her country afterwards. And honestly, why would she return if she is already married to you? Even if she already has a visa to enter as a tourist at this time, once she gets to POE and the CBP officer asks the purpose of the visit, she either lies (which she shouldn't) or she has a high risk of being denied entry.

If she's going just to spend face-to-face time with you, then you should be fine. Feel free to propose. If she wants to return to her country, as you say she does, then you can start the K1 process while she's with you, so she can sign all the forms needed. Then it's just a matter of waiting for processing times.
