US Citizen Marrying in Belgium - NEED HELP - CR-1

Ok, I'm not seeing anyone post anything like this out here.. I could use some help

I am a US Citizen - here studying abroad and my Belgian fiancee and I are getting married in May here. I must return to the US by the first week of July because of my internship and University. Can we file a  I-130 the day of our wedding at the local US Embassy? We want to be back together as soon as possible, together in the states. Or we send it via Fedex to the lockbox in the US? I keep getting confused with the information. ( We are a CR-1 Visa type I guess?)  We are having a very hard time getting clear answers. We also need help finding a paper addressing how to add a Co-Sponsor.

A lawyer is a bit much for us, so we're trying to do this on our own.

If you can DCF you go through the local embassy there. Takes probably about 3 months or so to process.

 

If CR-1, you mail it to the US for processing with all filing fees being drawn from a US bank account.

 

Co-sponsor needs to supply same I-864 affidavit of support form as you with all applicable financial documentation.

 

You need to also be able to show domicile in the US as to where you will be living since you aren't here currently.

08/15/2014 : Met Online

06/30/2016 : I-129F Packet Sent

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

There is no USCIS field office in Belgium, and therefore you will likely need to complete normal via mail processing (send it to the lockbox) CR1 process takes ~1 year during which time your spouse can VISIT you in the US

 

As to when you can file the petition, as soon as you have all of the required information and completed documents you can mail everything in

If you are able to get the official marriage certificate including a translation into English (if not already in English) the same day as the wedding, you can mail out the petition the same day

 

As for financial sponsorship, the I184, that is needed at the NVC stage which will be about 5 months give or take after you file your petition

For now focus on having a complete petition

You'll need to submit a copy of your Belgian marriage registration with the i130, making it unlikely to file the day of your wedding.
