Well the older version was only convicted of certain crimes. The new form is arrested for ANY crime. So you have to disclose everything with the new form. I could be wrong, but that's how I read it.

IMHO, if you used the older form where it did not ask for arrest along with convictions, you don't disclose it. But with the new form you do. Either way it doesn't matter as they will run a extensive background check as part of the adjudication process. I think the reason why they are asking for the arrest record along with convictions, is because it will help speed up the process when deciding to approve or deny the petition. IMO, it also looks like they are being more specific on the type of crimes as oppose to the older form. Depending on the type of crime that someone was arrested for, regardless of the charges being dropped, they may ask for additional information (RFE) as to details of the charges. DV, murder, assault, etc. are not just what they're looking anymore. They want to see as much as traffic violations (i.e. DUI's) which I think goes to a judgment of character as to the petitioner.

 

But at the end of the day, they have all that information privy to them so whether its the old form or new form, follow the instructions provided for the version you are using.

 

Those that have already submitted the petition prior to 6/9/2017, you don't have to send anything to them unless you get a RFE. Anyone still trying to get their old forms mailed, you (well, we...because I'm also in that number), have from now until 6/9/2017.

5/14/2021 - Received NOA1 via mail (NOA1 date: 5/8/2021)

Timeline

The new form includes the G-325A biographical information.  The idea is to have one form.  USCIS has not updated the website, but the intention is to not need the G-325A in the future and have everything on the new I-129F.  

 

They are still transitioning to the new form so give them some time to update everything.

 

What is good with new I-129F, is you don't need your beneficiary to sign the G-325A form, which can be a hassle for many of us where our fiance lives on the other side of the world!

 

If you've filled out the old forms, just send them in.  If you are just starting the process, then use the new form, and you don't need to fill out the G-325A.

 

If in doubt you can always call USCIS at the number in the instructions and ask.

Quick question - I've sent our application pack to my fiance (to arrive within a day or 2) with the old I 129F form. We plan on submitting with the new form (for my peace of mind), but the package that's on its way includes my original signed G325A. Since it's still somewhat unclear to me as to whether to submit it, can we just include it since we have it anyway?

Question on the new form, asks parents' names.  For the mother's family name, would that still be her maiden name? 

"Item Numbers 27.a. - 36.b. Information About Your Parents. Provide each of your parents’ full names, dates of birth, places of birth, and current cities/town/villages and countries of residence."

Yes you use the mother's maiden name.

Oh, so I do not need to send G-325A forms for myself or my beneficiary?

I know the checklist still states to submit the G-325A, but USCIS has not updated the checklist yet.

Submitting the G-325A with the new I-129F form is not required.  The G-325A information was added to the new I-129F form so now there is only one form to complete.

 

If you are in doubt, just submit the old I-129F with the G-325A (which you can still do), or submit the new form with the G-325A.

 

You can also call USCIS.

Hi, Good day to everyone.. My fiancee just finished filing the form I-129f yesterday. I was wondering if we needed to attach the Form G-1145 to it?  If yes what will happen if we forgot. and what can we do? I am from the Philippines and my fiancee is from U.S.

That's an optional form. Since you didn't send it, you just need to wait for the NOA1 to arrive via regular mail to get your receipt number.
