UPDATE! We closed last Thursday. The fact that he isn't a U.S. citizen never even came up. :)

USCIS (Priority date April 1, Approval April 17, no RFEs)

March 28, 2014: I-130 sent via FedEx from Bogotá to Chicago Lockbox

April 1, 2014: Delivered to Chicago Lockbox at 10:29 a.m. according to FedEx tracking; signed for by J. CHYBA (date confirmed by My Case Status)

April 4, 2014: NOA1 e-mail received at 12:17 a.m.; case accepted and routed to CSC for processing. Check cashed.

April 17, 2014: Changed mailing address with USCIS Tier 2 representative. He also confirmed that our case had arrived to the CSC and that our NOA1 date is April 3.

April 18, 2014: NOA2 e-mail received at 12:30 a.m. Case status online changed to post-decision activity; date of "last updated" changed to April 17. Change of address e-mail received at 3 a.m. Status changed back to initial review on e-mail and online. Date of "last updated" now April 18. Called and spoke to two Tier 2 reps; both were useless.

April 21, 2014: Approval confirmed verbally by Tier 2 rep. Order put in to send second NOA2 hard copy to new address. Instructed to ignore online case status.

April 25 or 26, 2014: NOA1 hard copy arrives to old apartment in Bogotá. Priority date actually April 1. (April 3 was the notice date.)

May 16: USCIS change of address e-mail received

May 19: USCIS e-mail received saying a duplicate notice was mailed on this date. Case status now set to "Acceptance."

May 22: NOA2 duplicate hard copy arrives to U.S. address

NVC

April 29, 2014: Case received

​May 22, 2014: Case number and IIN assigned. Asked operator about our move from Colombia to Argentina and received instructions.

May 24, 2014: E-mails about embassy change/address change sent to nvcinquiry@state.gov at 4:36 p.m. NVC time

​June 3, 2014: Payment portal message "This case is in the process of termination" appears. DS-261 appears, submitted. E-mails received from NVC concerning case number and AOS bill.

August 6: IV invoice e-mail FINALLY received at 2:13 a.m. NVC time

August 7: IV payment made available on payment portal; paid

August 14: Checklist received; errors on sponsor's I-864 form and on joint sponsor's I-864A

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Evening! So my wife and I are going through the same thing. We have a loan we are meant to close on next week. It is an FHA loan. I am on a Conditional Permanent Resident Card. We are currently processing on the i-751 (we actually are getting to the end of our year extension its taking so long....) Did other people on here get approved for an FHA loan whilst on a Conditional Permanent Resident Card?

Yes, we were approved while on conditions. The key for us was using a local lender and a really hard working realtor on our side. It was a long and daunting experience but when it finally wrapped up in our favor all was forgotten! Also, looks like we will be needing our stamp this coming month since it is taking way too long for my Husband's new card!

All I can say is keep copies of everything requested. Sometimes they asked for the same documents over and over again. Anything signed keep a copy for yourself as well. Lots of paperwork but when the LO is working with the underwriter back and forth it helps to know you gave everything they requested without a doubt. Every Underwriter has their own checklist in doing their final approval, sadly at first we got stuck with an underwriter who wanted more than we could offer them at the time for the green card. Our 2nd local underwriter let us know what we had was enough! I hope your process goes smoothly!

Hi! My husband and I are in this predicament right now...truth be told, I never thought it was going to be an issue (We are doing immigration the "right" way, aren't we? It should be smooth sailing! HA HA) until our mortgage banker (local bank) started asking about my husband's status. We applied to remove conditions on my husband's residency in December 2017 and his green card expired in February 2018. The extension letter says plain as day that his residency and right to work are extended for 12 months. The mortgage banker doesn't have any experience with this and says that the issue isn't with the underwriter, but with HUD (as we are getting an FHA mortgage). HUD will not approve the mortgage as it apparently thinks my husband isn't a "legal permanent resident" because his residency is conditional and his green card is expired. They have requested an EAD card, which my husband, of course, does not have because he is a legal permanent resident! The banker asked us to schedule an InfoPass appointment to see if we can get any sort of documentation attesting my husband's legal permanent resident status (because his extension letter isn't good enough, apparently?) OR an EAD card. We scheduled the appointment, but of course, we are not optimistic that we will leave with anything useful.

Has anybody obtained an FHA mortgage (using both spouses as co-borrowers) while undergoing the process to remove conditions? If so, how did you appease HUD? 🤯

I'm in the same predicament right now. I have my expired green card + my extension letter. Have been pre approved already, am in contract .. I will be meeting with a loan office on Wednesday.  She asked me to bring all the required docs including my green card. Hopefully everything goes well.. going the FHA program in NJ

We were pre-approved, too, but when we got to the mortgage application, we had problems. The mortgage banker never dealt with a permanent resident buying a house before, let alone one undergoing ROC, so he had no idea the "expired conditional" status would cause a problem with the underwriters. Good luck! Please update this thread when you find out more/close on the house!

It has been a crazy ride once my husband and I moved to the USA!

We are in the process of buying a home, in fact stuck in the underwriting phase of the process for the passed 4 weeks, our closing has been moved up 3 times already. 

Here in lies the issue, our underwriter can not seem to understand my Husband's status as a conditional resident.

He has his green card valid for 2 years until we file our I-751 in June, a valid non-restricted social security card, and driver's license and has filed for Taxes in the USA. 

 

  • The underwriter in the beginning of the process requested our EAD. Sent a LOE explaining we don't have one and do not need one as he is a conditional permanent resident. 

Waited for a week

  • Requested his I-94 form, again sent a LOE explaining we do not have that form as we came into the country on a CR-1 Visa to get his Conditional Resident Green Card valid for 2 years. 

Waited another week! 

  • Requested a stamp that we do not have at all yet, called the temp I-551 stamp that validates an expired green card for another year until you get your 10 year green card. Send an LOE explaining we are not yet at that part of our process as a conditional permanent resident as we must file 90 days before the expiry of our green card, which is not until June 10th. Explained this can not be done any earlier and the stamp can not be supplied by USCIS unless new green card never arrived in allotted time of 6 to 12 months after filing I-751 form. 

*much cursing, headaches and calls to our Loan Officer later...*

 

Find out Underwriter has stopped communications, won't give us an update and left us basically at the stage of where they asked for the stamp we can in no way get. 

 

Has anyone ever bought a home as a conditional resident before they filed their I-751 ROC form? I have searched the forum and have only found people buying a home while waiting on their new green card, and a few comments stating they bought a home on CR-1 without any problems. 

 

My husband is the only one on the loan application as a permanent resident for FHA guidelines, the Loan Officer said we had everything in order as far as documents went and we were approved with conditions until the underwriter suddenly kept adding more conditions that made no sense. We may end up losing about 2k (2 appraisal fees, earnest money, home inspection...) and worse yet losing the home because of this confusion. 

 

Any information or even those with the same experience is greatly appreciated! 

Yes we bought one.

 

I was on the loan, we were jointly on the deed.  Problem solved.
