2015 Taxes or 2016?

Timeline

In Jan. we sent in the AOS package with the co sponsor's 2015 taxes. Now we got a checklist for not adding pages 10,11, and 12 from the co sponsor's i864 affidavit of support.

They asked we send in another affidavit with the missing pages.

 

My question is do we now have to send the co sponsors 2016 taxes? (By the time NVC finally opens the case to review the deadline will be long gone)

Hey, just to make sure, the checklist you're talking about is an RFE, correct? Personally, I really think you'll be okay with the 2015 tax transcripts that you originally sent in. I'm guessing the deadline for using 2015 tax transcripts is April 18th? So if that's correct, I think you should still be fine, as long as they receive the RFE response before that date. After they accept it, it'll be added to you file and could take months before you petition is reviewed, so everything would be out of date by then anyway- so I'm pretty sure both NVC & USCIS go by NOA 1 when they receive petitions to avoid more confusion. Going by that logic, you'd be fine tax wise as well, because it'll have been submitted/recieved well before the 18th of April :) 

 

If it makes you feel better to include 2016 tax transcripts, and you have access to them, I don't see how it could hurt your case, unless you've earned significantly less than in 2015. If they didn't explicitly ask for additional information though, I don't think they are looking for updated tax transcripts...otherwise I am sure they would have written that on the RFE as well.

 

Hopefully some other users can chime in with their 2 cents, because this all just based on 'what I would do' and isn't 100% perfect, I'll bet- but I hope this helps you out! Best of luck :)

Thank you for your reply. I mean checklist as is in we got it from the NVC after we sent in the AOS and IV packages.

Awh okay I'm sorry I totally misunderstood!! :blush: I saw this and was like, "wow I can totally help!" Sorry about that!! :dead: I hope someone else can come on here and help out better than I have haha.

If they receive the checklist before the taxes are due then no, but when in doubt, send them.  You'd likely need them for interview anyhow.
