Filing for DCF if not permanant resident

Can I file for DCF if I am not a permanent resident? I have been living in the Philippines for 5 years, but because I still work in the U.S., I was never able to apply for permanent residency.  In order to apply for permanent residency I would to have stayed in country without leaving for a certain amount of time, which wasn't possible for me.

   I live here in the Philippines every other month and work in the U.S. every other month. So technically I'm not a permanent resident anywhere, as I did not have a residency in the U.S. for 5 years. So does anyone know if I can still file for DCF?

I do not have your exact experience and situation, but when I was living temporarily in the Philippines, all that was needed for me to file DCF was some evidence like a rental agreement that shows that you are living there, and have somewhere formal for the emabassy to send papers to.  If I recall correctly, I manually delivered the initial paperwork to the embassy (this is going back to 2007, so things may have changed...), and the guy who looked through the papers I was submitting noted that I had a signed rental agreement and accepted the submission.

But if someone else has more recent experience, listen to them not me....

How are you living in the Phils, on what kind of visa?

I filed DCF last month, only needed a lease agreement. I'm here on a tourist visa. I'm pretty sure you have to be here for six consecutive months though to be able to file, i could be wrong on that part though.

I'd recommend calling or emailing the USCIS local office there and clarify what exactly you need to be able to apply. We did that here and it was immensely helpful to know exactly what counted as residence or not and what they needed.

Great! thanks everyone for your thoughts and experiences. I am living here on a tourist visa that I renew every 2 months. And I have also have been living here consecutively for 20 months, so that shouldn't be a problem.  I have rented the same apartment for 5 years from a lawyer....so I'm sure he can draw up a formal rental agreement for me. Thanks again for the help.
