Iam US citizen and my husband NRA he came August 2016 on K1 visa and still has AOS under processing and has no U.S. source income from August to the end of 2016 , and no health insurance and we file MFJ , did the Coverage Exemptions going be for all year 2016 or just for months before he move here

When you do your tax return you now have the choice of leaving blank the question about health insurance. We chose to leave it blank. My wife has insurance but I do not. We did not have to pay the Obamacare penalty and we received our full refund. It's entirely up to you but I just wanted to let you know that you don't have to answer the health insurance question if you don't want to.

There's a health insurance waiver, form 8965. You put exemption type C for all months before your wife immigrated to the US, including the month she immigrated (January to August). Then you can use exemption code B for three months of the year she was in the US without insurance (September to November).

 

ACA is still in effect and the health insurance waiver form is still on IRS' website and considering that you can be audited up to six years after filing, we felt that it was better to declare the lack of insurance part on our return then leave it out and be potentially penalized in the future. At least that way, you're honest about not having insurance for the full year, IRS won't charge you the penalty for not having insurance anyway and your "hands are clean" for any potential future audits, because you declared it.

OP: All persons living in the US, most obtain health insurance or pay a penalty. That is the law of the land, and nothing thus far has been changed regarding that issue. Your husband has been living here since August 2016 and still has no health insurance? He could have obtained health insurance quite some time ago. Why are you waiting? Exemptions to be filed are only going to be what mallafri76 describes. If your husband wasn't living in the US they don't need coverage for those months. But for the months he has been living in the US the penalty for not having coverage may apply if he meets the terms of the IRS various tests to determine the issue. He does not require a green card to obtain health insurance, so the longer you wait, the more time will pass for the penalty to apply..
