I-864 vs 1-864A

Hi Everybody,

My uncle is in the process of filling up his 1-864 for his spouse.  His income is under the required level.  My uncle is residing with me.  I am planning to be his co-sponsor.  Do I need to fill up I-864 or I-864a (same household?).  He is not my dependent nor I am his dependent in filing tax return.  Does living in the same place constitute being the same household (I-864a)?

Thank you.

It sounds like you are simply room mates, not financially tied.  Thus, you would fill a separate I-864.

Thank you.

Penguin_ie is right... however, I just want to let you know that I had this same thing with my case and got a checklist. I am sponsoring my husband and I needed a joint sponsor. I live with my parents but are not claimed on their taxes as a dependent. I submitted the I-864 for me, I-864 for my father (joint sponsor) and an I-864A for my mother.

We got a checklist. NVC wanted me to re-do the I-864 for my father as an I-864A because we resided in the same house. Again, we are essentially roommates -- and are not claimed on each other's taxes. We submitted the I-864A as directed and got a CC. Lesson here is that it could be up to the individual officer's interpretation... just wanted you to be aware.
