2 or 10 years GC

Hi,

 

I was reading about the green card process and I have one doubt. I read that if you get your GC after 2 years married it will be a 10 years GC, if less than that it will be a 2 years GC. My wife applied to me, and my case was sent to the nvc, so it will take some time until finish everything and have the interview. In June/2017 it will be 2 years since we got married, and my GC will probably be after that. Will they give me a 2 or 10 years GC?

Well, it is. It was talking specifically about the 2-year marriage anniversary. It starts right where I quoted it.

 

It is saying this: " In case you are going for an interview for marriage based green card, and if you and your spouse have reached the 2-year anniversary of your marriage since filing the application, make sure to remind the officer so that you will be stamped for permanent and not conditional residency."

No need to alert the IO at the interview because what matters is the PoE relative to the 2 year anniversary

For example you can interview before your 2nd anniversary but enter the US after your second anniversary, in which case you get a 10 year GC

 

Yes it is appropriate, if not asked at PoE, to remind the officer that you have been married more than 10 years

 

Regardless of how long one has been married, the passport endorsement only acts as a temp GC for 1 year

One of the beauties of these forums is the trove of knowledge, experience, caliber of peer review of answers. There is also the beauty of  plain hearsay and speculation. 

 

Unless a poster is very specific and clear on  a query, answers are going to come from people with diverse experiences, understanding (and assumptions), about the query.

 

That said, I find it laughable that we are to assume that the IO, or the officer at the POE, whichever case  may apply, has forgotten a question that is so important to the issuance of the GC that it falls upon the beneficiary to nudge them with a "gentle reminder." Such a "gentle reminder" will probably elicit an uninterested nod or stare-back. They know their jobs. They are probably sitting behind a screen that has already alerted them of, in such a case as this, the marriage date the moment they punched in data from the passport or scanned a card/visa/whatever. 

 

If there is anyone in these forums who has ever given the officers a "gentle reminder" and they responded with "Oh blimey! Thanks! I had forgotten that!" by all means come forward and and say it.
