We got married 12 days after 90 days for k1 visa by mistake and my application got denied please help if you have any information

Hello everyone,

We got married 12 days after 90 days for k1 visa by mistake we tought once we got the marriage licence that we are officially married within 90 days because we did the ceremony 12 days after and thats what they count,  I recieved the decision letter today stating that my application was denied and my wife has to leave the country, my question is there a way my wife could remain while we re apply for adjust of status i-485 ?

So your Marriage certificate was issued 12 days after the 90 days?

or you have actually married and made the cerimony after the 90 days. If this is the case i dont see any thing wrong with it since you have sencerly married your wife and living with her in the same house!

Did they interviewed you and your wife?

Thank you for response first, and to explain further,  the 90 was ending 06/04 days we went and we got the mariage license on 05/15 and we tought  at that point that we are legaly but we had the ceremony on 6/15 and that's why they counted this day and denied the application

If you married past the 90 days you will need to submit an i-130 petition with your AOS application.

You had the marriage license but not the certificate. The marriage is only registered after the ceremony.

Yes. Like I stated above. Resend your application and include a i-130 petition. She's no longer a K1 adjuster. Your wife will adjust status as your spouse so you need a new petition, i-130. She will adjust status like anyone else that got married to a USC and stayed in the US.

Until USCIS have received the application your wife will be out of status, but this overstay will be forgiven for the spouse of a USC once you file to adjust. Don't have her leave the country, cause then you will have to start all over with a CR1 visa petition from abroad and she might not be able to visit during this process due to her overstay. You would also need a waiver for a potential bar in that scenario.

So how did they know that you were not married. Did they interview you and your wife or you said that in your application?

So the first step is to file out the form i-130 and i-485 and sent them to the uscis box and ignore the decision letter that stated my wife has to leave the country as soon as possible?

You have to send a copy of the marriage certificate with your application.

Filing for AOS by marriage requires sending a copy of the marriage certificate. The marriage certificate would have been dated after her I-94 stamp.

 

@Suss&Camm has provided excellent advice above. The OP did not meet the conditions to AOS via K-1 since he married after the 90 days. However, his wife can still file for AOS as the immediate relative of a USC, but he has to concurrently file an I-130.
