Hello guys, I have a question.

I came to the US in 1992. In 1994 I married to a permanent resident and we submitted my application, that did  not go anywhere cause we got divorced about 2 years later, and I did not get anything from INS (that’s how it was called then). A few years later I meet someone from El Salvador, she had TPS. We were together for about 10 years and we had 2 kids (never got married). In 2011 we broke up. I started dating an American girl (parents are from Puerto Rico). She was upset when she found out that I was in the US illegal. We got married on February 2012, about 5 months later we submitted the I-130 for me to become a resident which I did about 4 months later. She was wild, drank a lot, we had a lot of fights over stuff like that. She got a DUI like 1 month before out appointment with USCIS. She got worse and worse, she also got caught smoking pot and got in trouble with the law, she got pregnant and lost the baby probably because of the drug abuse. Also child services came to our house 3 times, she has two kids and they kept getting in trouble and the father of the kids kept calling social services on her. She ended up cheating on me and go pregnant again, I left. This was in December 2015 (I had applied for my Citizenship and I became a US Citizen 3 months before or so).  I did not have a place to go, the house where we were living was mine but I could not kick her out cause of the kids. She kept telling me that she was finding a place to move, which she did like SIX months later. We got divorced even before she moved. In the meantime, I continued visiting my kids and started spending more time with them and my ex, and yes, we got back together this past December. This time I want to marry her and also I want to send the I-130 petition for her; but she does not want to get married and she thinks that in the event that we send the application it is going to be denied cause I was with her, left her, married someone else, got my papers, and now I am back with her. I keep telling her that almost a year passed before I got married to this other girl after we separated, also I was divorced last March and we are not even married yet. What do you guys think about this?? Should we get married and send the petition or should we just leave it alone?  She has TPS so she is legal but she cannot leave the Country and because she entered illegal in 1995 we may need a pardon ( if there is one). What do you recommend?

Thanks.

  • 2 years later...

So if you are a resident of us and she has tps am pretty sure she can adjust status because when she got tps she is admisible in the us. You need a lawyer. Good lawyer. And stop ###### up so much lol. Hey check if you or her have parents that had the 245i. If u or her have it, she can adjust status and get her papeles here in the usa son. I hope u can stay with one woman lol
