May I also suggest you contact www.masliah-soloway.com   They are a law firm that "specializes" in same-sex cases (and were our attorneys).  They will do an initial consultation free-of-charge.  See if you can get your question about your civil union answered conclusively.

 

We are in the same boat - we were "registered" as partners in Australia, but got married in the US and pursued the CR-1 route.

Our Prior Journey

N-400 Naturalization

18-Feb-2018 - submitted N-400 online, credit card charged

18-Feb-2018 - NOA1

12-Mar-2018 - Biometrics 

18-June-2018 - Notice of interview received

26-July-2018 - Interview  - APPROVED!!!

26-July-2018 - Oath Ceremony Scheduled

17-Aug-2018 - Oath Ceremony

Timeline

Here's a short update:

  • Civil Unionship is not recognised - we have to file everything checking the "single" checkbox and go the K1 route.
  • A certificate of no impediment / marriage affidavit is not required by the state we plan to get married in. 

Basically we're single in the eyes of the US and are married with all the benefits in Austria.
