Sponsor problem - other options

Hello,

 

My wife was in college, and now she is working for just 6 months, so she is not making enough money to be my sponsor ($13k on w2 2016) and we don't have anyone else to be our co-sponsor. Do we have other options, instead this sponsoring thing? Since she lives with her parents and don't have rent expenses, so she doesn't reach the 125% poverty guideline but at the same time she has less expenses, can it help her sponsoring me? (sorry, confusing thoughts)

The living with parents does not matter so much.

 

She would need a co-sponsor though as you have stated.

 

For herself to bypass the co-sponsor by herself, she would need to use assets to make up for the difference in income.. this means i think 5x the amount missing in savings/assets.

 

Her parents will not co-sponsor?

I don't think her parents have enough to co-sponsor. I have assets/savings, but it's all here in Brazil, and her savings are not enough. So if we could not use my savings for this, we will have to find someone to sponsor, I just don't know how, hehe.

There's no way around the 125% poverty guideline. If the main sponsor (wife) doesn't make enough, either with income or assets, you guys will need a sponsor. If there's no sponsor, there won't be any visa. Haven't you thought about that before applying?

 

What about current income? If her income last year wasn't much, if she now has an income above the poverty guidelines, it should count.

I believe that a letter from work plus recent paychecks can attest to her current income, if it's over the poverty guidelines

Yes, it is, but she works for just 6 months, so her w2 doesn't show enough to be a sponsor, but if you calculate the same payment for 12 months it will be enough to sponsor. Thanks.

Yes it is current and ongoing income that counts, so if she can document it and add a letter from the employer that the job is stable and long term, she should be fine to sponsor alone.

The requirement is not that she earned more than the 125% poverty line.  The requirement is that her annual income would meet the poverty line.  There is a difference is between earning more than the poverty line vs. an annual imore more than the poverty line.  

 

As long as her current annualized income is more than 125% poverty line, in most instances you will be fine without a Joint Sponsor.  (I will not say you are 100% good because we live in strange times.)

One more thing (sorry).

She was in college, so she doesn't have tax return from 2014/2015, is it a reason for them to ask a joint sponsor, even with the W2 filling the requirements?

She has her 2014 tax return, but she doesn't have her 2015 tax return. Do you think it might be a reason for them to ask for a joint sponsor? 

 

ps: sorry about all the questions, but we don't have anyone to be a joint sponsor, so it will be a problem if they ask it.
