Question about Aos k1 visa

Hey Guys,

 

We got our K1 visa last week.

 

The biggest step is gone, and now it is time to apply for Aos. I have several questions about Aos

 

1-) We went to the interview last week Jan 26 2016 and so we have used 2015 tax return. In this tax return I did not make enough  $19,766 adjusted gross income line 37 and I had my bank account statements and w2. in 2013, 2014 I did not make that much because I did not have job and in 2015 I had my own business. While applying i-867 affidavit support, they are asking previous years but they are not asking to document it and they consider only the most recent tax return. 2013  $6K, 2014 $4K 2015 $19,776 (So thats why I have got the visa if they were looking all 3 years they would not give the visa right?) SO my question is when I apply for aos in February 2017 should I give them my 2015 tax returns? I am not planning to do 2016 Tax return until April but I want to apply aos asap!

2) on the usics website, they are saying we k1 visa holder do not need to do medical again. So am I going to fill i-693 again? I do not have the copy of medical report but vaccinations and have the yellow envelop.

Firstly, they look at your gross income, line 22 not AGI. Secondly it is your current income that matters in both K1 and AOS it is just up to you to be able to prove that the current income will be enough and ongoing/sustainable. For some ppl the old returns might help to show the ability to maintain the income, but you can provide other evidence to prove this, such as employee letter, last 6 months paystubs etc. The old information is required because you are required to have filed taxes for those years.

No you do not fill out i-693 as a K1 visa holder if your overseas medical was done within a year and all vaccinations are received and the DS-3025 is marked as COMPLETE. The yellow envelope? Did they not take your medical at POE? If they did not then you send it with your AOS application.

And yes, the 2015 tax documents are fine, just make sure to send along w2's and all and any tax schedules.

by the way I see most k1 aos filler do not go  interview right? they just get their green cards.

It depends. Quite a few are waived since the recent K1 interview. There is a higher chance to get waived if your case was/is straight forward and easy and without red flags and such, but even a straight forward case will get interviewed sometimes. No way of knowing who will and who will not be asked to interview. :)
