K1 denied. Next step and documentation needed

I'm so sorry to hear you are going through this.

 

I've been part of visajourney for the past 6 years this year (crazy it's been that long) and unfortunately, Ghana is considered as a high fraud embassy like other member said. I think Ghana and Nigeria are definitely the toughest ones.

 

However, CR1 visa petitioners have a better luck. At this point, is almost pointless trying to inquire about the reason why they denied your petition and to be quite honest is not hard to tell. High fraud embassy+ beneficiary student visa denied...sounds like your partner just want to move to the States (that's how they see it).

 

I truly support the advice one of the members gave you, slow down a bit...this is not a sprint race, is more like a marathon. Is not about how fast, is how you do things...of course, I absolutely understand the urge of having your loveone here with you but you are not in an easy spot unfortunately.

 

  1. read all the topics and posts of your embassy...noone knows better than the members of your country...try to find people who went previously and successfully through the process. Take advantage of other people's experiences (good and bad)
  2. Try to invest in more visits before reapplying. I know is a long trip to Ghana but maybe you can meet in another country...choose a common ground and try to see and visit each at least one more time. 
  3. Frontload like there is no tomorrow. Tough cases needs more proves....and is not about sending 10000 of pages of the same thing...that's a huge mistake that I see here often... the key here is VARIETY OVER QUANTITY. is better to send a few pages of different things...ex: pictures together and with friends and family members, emails,text logs, call logs, skype logs, facebook screen captions where it shows that you have each other listed as husband/wife or partner, caption of congratulation messages from friends and family on social media, letters, cards, whatsapp chat logs, of course: flight itineraries, passport stamps, flight tickets, hotel receipts, restaurant receipts, gift receipts, information of any account or property that you might have together etc etc. I'm a former K1 visa beneficiary who was engaged (now happily married) with my 3rd cousin once removed. Even though we were not raise together and our blood bond is pretty much non existent, we are related so that raised a red flag back in 2011 when we applied. I kid you NOT when I tell you and brought almost 10 lbs in paperwork, pictures and anything that might be used as a proof of a bonafide relationship...my then fiance (now husband) went with me to the interview as well, to improved my chances. I truly believe all our extra efforts paid off, of course, I got my visa and I was able to moved with my love and started our family.

I truly wish you nothing but the best...I know is a long painful road but is SO SO worthy...I can tell you, going through this process with my husband truly made our relationship and commitment even stronger. This is not a solo kind of thing...is truly a team work. We are about to celebrate our 5th wedding anniversary in a couple of months and we still never take any moment for granted and this in part, for all the time we spent apart from each other.

Thank you all for your response. My next question is my husband and I don't have anything that ties us financially. May I submit my application now without that factor? We plan to get a bank account together when I visit him in July.

It is best to have the bank account statements frontloaded to USCIS because Ghana is such a difficult embassy.
The whole point of frontloading is that the CO will have seen the evidence already when they preview your file
before the interview and they make up their minds often at that point.
Read through the ROC guide list of what you may add as evidence, such as wills, power of attorney, land or property in Ghana he can add
your name to as joint owner. You may find one or 2 items you are not thinking of in this link.

Visa Received : Nov. 3 , 2014 VISA IN HAND.

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

EAD/AP combo card mailed : Aug 27, 2015, EAD/AP combo card received: Aug 31, 2015

EAD/AP (renewal) approval Aug 22, 2016, NOA2 received Aug 25, 2016

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.
