I-131 Rejected....USCIS Reason Seems Inaccurate...Please Help

Huh,  I dont know then... Its been years since I filled out the 131. I think we filled in that part- but Id have to go digging around in the filing cabinet to check the copy of what we submitted. 

I did pull up the current form from USCIS- and just like it was posted when you check 1d you can not fill out the remaining questions (#2). But oddly when you check 1f you STILL can not type info into #2 as well---??!! So there may be a glitch with the form. Because if one needed to check off 1f they would have to manually enter the info in #2.

If there is some kind of glitch- with the new barcode thing they have along with it- it may be causing these 'denials'... I really dont know. The only thing you can do is submit it again and hope for the best.

Should work if you download it and open it from inside Adobe reader and not from the web browser.

Just checked.. yes it works that way... blocked, when choosing 1d but works when choosing 1f

 

The i-864 has the same problem when filling in household size. There have been several rfe's for ppl that have filled it out using the web browser.

We left most of the entire application blank.... We only filled out part 1 for my husband, checked box 1.d. and then a few other check boxes stating he's not in any deportation proceedings, he hasn't been issued this before, and that he expects to use it for multiple trips - we didn't have a set travel plan and we didn't need one at the time of filing. And we ended up getting the AP no problem. 

 

So weird that they rejected it. But who knows. Just send it back in with the explanation like others have said. Best of luck!

Thanks for all the info and suggestions, everyone. 

 

Looks like I'm basically going to have to fill it out again. Finally got in touch with a next tier customer service person (helpful but still rude and impatient, btw). Here's what I got: 

 

1) Re-do the form. Tracked the I-485 for me and said it's in Missouri (sent it to Dallas, though...hmmmmm???) office and I'll need to resubmit and send my application there. Uhhh, thanks? Not a single mention of that in the rejection letter. Again I'm left unsure of how to approach that now. In any case, I have a copy of the I-485 receipt I'll be attaching to the application. I imagine with that it wouldn't necessarily matter if I sent it to Dallas (the office per original instructions on USCIS website) or Missouri, I think the rep just suggested I send it there since that's where my application is actually physically located and  I wanted to make sure I was not rejected again due to not including payment. She suggested to put a note to "file with I-485 application and receipt attached". 

 

2) So no rep could really explain why I was rejected due to lack of information in part 2, which I think we've all concluded does not pertain to me. WE ARE ALL NOT CRAZY...pretty sure we all got it right here in terms of understanding the instructions, that section definitely did not apply to me. Customer service solution: Put a sticky note on it, "same as above" or "does not apply". She was implying that putting a note at least shows the reviewer where they can find the information, despite it not applying to me? Errr...ok.  I figure there's no point fighting it and trying to understand it. Just gonna re-do the app with post-it note explanations and hope for the best, lol.

That's so screwy. When my i-765 was rejected they also sent me a rejection notice where it said to resubmit the application to the address of the bottom on that notice - it was the same address as I had used for the whole AOS. Chicago lockbox. Did you not get a rejection notice? I wouldn't trust what they tell you at the misinformation line.

The only thing the rejection letter says "you are welcome to resubmit...". Does not specify where. Which btw, I emailed the lockbox email provided a week ago and also have not gotten a response. smh.

Also, every time I call and ask for clarification, the reps are VERY robotic in their response to "follow whatever instructions" were provided to me in the rejection notice. Basically, they don't want to be the ones to give you wrong info. For example, I asked about resubmitting the rejected app or a new app b/c the forms had recently been updated: "you can resubmit following the instructions you received". Oh...ok...well how about photos? I submitted that with I-485 previously, Do I have to do that again?: "you can resubmit following the instructions you received".

Yes I sent the whole thing again, copies of everything I sent with the first application, and passport photos. Didn't get any of that back when they rejected the first one.

Ok...So separate issue / question for those of you following; but still related: Evidence and reasoning. 

 

In 2014 when our friends applied for AP they had to list reason for request and it was as simple as "to visit family and friends". I've seen their application and it definitely has changed since then and gotten more strict. Since the update, as those of you with experience know, we have to have a qualified reason and list evidence and description of why we feel we qualify for AP. 

 

Our reasoning, under the definition in the application, is for humanitarian purposes. Or in other words, my wife's grandfather is ill and we want to visit him. Now, while he is not on his deathbed, he is definitely sick and his condition has worsened since she has moved. In the instructions it requests proof or evidence in the form of a letter describing his condition from the hospital. Also, given the average approval time for I-131, we would have to request that this be expedited since we would like to visit in March and then again in May. The expedite instructions say to "include a written explanation for the request to expedite with any supporting evidence AVAILABLE". 

 

Please give me your input because one description of evidence sounds absolute in that we need concrete evidence and the other is suggesting to provide evidence if available. I ask because my wife's parents are not technically savvy and it would be pretty difficult to go through the process of asking them to work with the hospital to obtain a letter about her grandfather's condition. Ideally I would like to submit with just a letter explaining the situation and hope to get approved with that.

No you don't have to give any reasons as to why you want the AP when you've arrived on a K-1 and file for AOS. You don't even have to put a date on the form, you write unknown unless you want to make up a date.

Yeah, I did. Followed it to the tee. Part 2 is left blank, just the same as I did and still got rejected. Pretty certain the person reviewing it missed this.

Ahhhh, I see where I might have misunderstood now. 

 

Looks like all I need as far as evidence is concerned is the receipt for pending I-485; that's relieving. Blue brackets in the image below only applies to item (5) then it seems? Which does not pertain to me?

On the form itself it says to explain how you qualify what circumstances warrant issuance of advanced parole and to include copies of documents, further to see instructions for this.

In the instructions it says:

 

"c. Advance Parole Document for individuals who are currently in the United States:
If you are in the United States, you must attach:
(1) A copy of any document issued to you by USCIS showing your present status, if any, in the United States; and

(2) An explanation or other evidence showing the circumstances that warrant issuance of an Advance Parole
Document; or

(3) If you are an applicant for adjustment of status, a copy of a USCIS receipt as evidence that you filed the
adjustment application;"
