Staying outside US more than a yearas GC

Hello,

 

First of all i am sorry if i am posting in wrong thread. My question is one of my friend (Green Card holder) married with UK citizen and now she is living with her husband there. She is outside US since 14 months. She didn't take any permission or apply any form for overstaying outside of US. 

 

Now if she wanted to come back US what will be the process? Or how can she find out that her GC is still valid before making plans to travel to US?

 

Any help will be really appreciated.

17th January 06----I-130 Approved

NVC

6th March 06------- Receive DS3032 letter (in Pakistan)

10th March 06----- DS3032 sent back to NVC

20th July 06------- Receive duplicate DS230 packet

14th September 06-----Case completed and sent US embassy Islamabad

ISLAMABAD EMBASSY

7th November 06----- Embassy upgrade my petition from F2A to IR1.

8th November 06----- Receive packet 3.5 through TCS.

16th November 06---- Embassy receive packet 3.5 and pending for review.

18th January 07----------- Receive Packet 4.

26th March 07------------ Medical Done

29th March 07 ---- INTERVIEW AT 8:00 am

APPROVED ---------- AP Starts

13th July 07 --------- AP END RECEIVE VISA

She can try to enter.  However she should have applied for either citizenship or a reentry permit before deciding to stay away from the USA for so long.

She should have been notified if her LPR status was revoked. No idea if she would have received that, though...I don't know if her current mailing address on file is somewhere she is still receiving mail. However, I believe they are more likely to deny entry at POE on the basis that she abandoned her permanent residency (which it sounds like she technically did).

 

Agreed - she should have requested a re-entry permit if she intended to return.

Thanks for the reply. She didn't receive any mail as her mother still lives in US and she has the same address. I agree she should have requested re-entry permit.

 

Is their anyway if she can find out if GC is still valid before making plans to travel back to US? Or simply just buy a ticket and see if she can be allowed at POE?

Nothing I can think of off-hand. The closest is checking her work eligibility via self-check:

https://myeverify.uscis.gov/

 

That said, I don't know if that would confirm her status is still valid (i.e. a positive test). It would only confirm a negative test (i.e.if it comes back invalid, then I would assume her status is no longer valid).

Sounds like she abandoned the US as her home by living in the UK. She has stronger ties to the UK. 

What's the purpose and intended duration of her US trip?
