Hello everyone,

I am the beneficiary of a k1 petition and i have couple of questions.

* Should I fill a seperate DS 160 for our(my fiance and I) 7 years old son?

* If USCIS has approved our hardship waiver for not meeting the face to face requirement can the consular officer deny our visa because of this?

Thanks in advance.

 The only time the child should arrive on a K2 is if they are not the biological child of the petitioner.  If that is the case, then yes a separate fee and ds-160 would be required.

I cant answer the second part...

To the second question, the CO can deny the visa based on lack of relationship, so IFF you were able to get the petition approved (VERY UNLIKELY) then yes there is a chance it could be denied for lack of a bonafide relationship

Not meeting goes to "relationship proof" and they can deny based on that.

If you got your meeting waiver approved, we'd really appreciate it if you posted details of your case, evidence you provided etc- we often get questions about them here and it is extremely, extremely rare to get one approved.
