Do i need an i 601a? (merged)

Hello I'm new here so hopefully someone knows the answer of my question, i came to the us in 2011 with a visitor visa and my moms husband petition for us but we got declined and the sent us a letter saying that we needed to leave in 30 days, but i stayed. Now I'm married and want to apply for i 130 and i 485, do i need a i 601a or can i just apply w the other forms?

Timeline

Since you entered legally, assuming you never left no, you should not need a waiver; overstay after legal entry is forgiven wehn a USC spouse files for you.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
