K-1 Visa for undocumented fiance in france

i had a us citizen fiance and he wanted me to process the papers here in france. i am undocumented at the moment. is it possible to do it here with the help of immigration lawyer? or do i need to go back to my country? thanks in advance...

Where is your regular country? France is known to be an easier consulate, so that's probably why he wants you to do it there. (We just had someone say they were going to go to France to do stuff about a month ago because they had a hard time with the Thailand embassy).


Either way, you probably want to be legal in the place you are at. It's not going to look good on you at all if you're not. If you're willing to be undocumented in one country, you're willing to be undocumented in any other country is probably how USCIS will see it.

Go back to the Philippines, it's likely faster to get a k1 there anyway.  They have an unofficial expedite

Agree with poster above. You need to have legal standing in the country you're in to be able to process there.

 

Just return to the Philippines, it's a simple process through the Manila Embassy with the K-1s generally.

If you just return to the Philippines, and the USC petitioner files for I-129F for the K-1 for you, using the guides here on VJ, you both can manage it without a lawyer.

 

If you try to stay illegally, or 'undocumented' in France, I do not believe a lawyer could help at all honestly.

ill just go back then. thanks for the info. =) my fiance and is almost 5years now.

As long as your case doesn't have any red flags, like crimes committed or something like that you shouldn't need a lawyer.

How long have you been in France though? Technically you're suppose to get a police certificate/report from any country you've lived in for 6 months or more. I don't think you'd have a good time getting this report if you've been in France illegally. If you were in France legally at some point for more than 6 months, make sure to get a police certificate before you leave, so you don't have to try to get it while outside of France.

been here for 5 months illegally.
