Timeline

My Thai wife has 2 children with her former spouse.  They were never legally married.  Do i have to list him as a former spouse of my wife? I have listed him as the father just because kids can not come from one person. Also we have already got him to release custody of the children. The children do not have his last name. I am just stuck with this question of listing him as a former spouse.  Completing G-325 for i-130.

If they were never legally married... then no... just being the father and listed on the birth certificate even doesnt mean that those two have to have been married.

08/15/2014 : Met Online

06/30/2016 : I-129F Packet Sent

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

Timeline

If they were never married, then he was never a spouse.  Don't list him as a spouse.  If you list him as a spouse, then you better be able to show her divorce decree, otherwise her marriage to you would constitute bigamy which could be a bar for her to immigrate to the US.

 

Answer questions directly as asked.  Don't read extra stuff into them.
