Wrong NOA2 !! plz HELP

Hello, 

 

I have filed i130 for my husband and didnt make any mistake in the application and after a year and few months my case was finally approved. However, on the approval notice it says " tho petition indicate that the person for who you are petitioning is in the United States and will apply for adjustment of status" 

My husband is NOT in the united states and he never were. 

 

They said to file form i825 for them to sent it to the national visa center!!

 

 I have made many inquiry's and talked to them about this mistake and uscis said they have forwarded it to the NVC and i had to wait 6 weeks to hear from the NVC and at the end they didnt recieve anything and my case is still in uscis!! 

 

Do i have to file form i825 and pay $420 and wait 6-9 months for an action on my case 

even though its not me who made this mistake? 

 

What i should do my case was approved on  August 2016 and until now I have not heard anything about my case!!! 

 

Im so confused and stressed can anyone help me ?? Its been more than four months ..

If you call USCIS again, make sure you speak to a tier two individual for a status update.  Also try calling the NVC (if you haven't already done so) to see if they have your case.  If both agencies keep passing the buck by referring you to the other agency, then you will need to involve your Member of Congress or one of the Senator's for your state.

May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

I have done every thing 

my lawyer keeps telling me to not fil the form i825 because it will take time and on this case it was not my mistake 

it was probably the officer that interviewed me  before approving my case. 

 

My senator keeps telling me to fill out form i825 and pay for it for further action  on my case 

 

i didnt understand the purpose of the form and I have called uscis so many times and they didnt give a clear answer about this form and if i really need to do it.
