Yes I 130 is approved now ,

No I am not married as it will void my F2b status.

Denial because I filled on the basis of CHART B in OCTOBER 2015,when the priority dates were not current. ,but clearly written on the October bulletin to submit your papers.

I thought your visa was expired in October. 

So did you become student after the AOS was denied ?

If not how you are maintaining your status with expired visa and AOS denial?

i filed in october too with chart b being current. is your visa expired when you filed?

08/20/2015: I-130 package sent  (Priority Date)

12/30/2015: 1-130 Approved

 

06/01/2016: Welcome Letter

 

I-485/I-765/I-131

10/28/2016: AOS Application Package Sent to Chicago (UPS)
10/31/2016: AOS Package Delivered
11/15/2016: E-Notifications received
11/21/2016: NOA received in mail

11/28/2016: Biometrics Appointment Letter received

12/07/2016: Bio metrics Appointment

01/22/2017: EAD is being produced (118 days)

07/03/2017: Interview is Scheduled

08/07/2017: Interview Day

08/08/2017: I-485 approval letter mailed

08/10/2017: permanent resident card mailed

08/14/2017: Received permanent resident card (almost 2 years journey)

No, 

 

I was/am in status.

Not even a single day ,I have been out of status for the past 9 years. 

And the IO asked me to file a new AOS

But my concerns are what I am going to do after denial.

I hate that they don't take a look at papers closely. My application too is subject careless scrutiny :(. Try doing an infopass and if not you might need to appeal. Keep us posted with the denial letter.

You filed for AoS when your form i-130 is still pending.......you can only Adjust status after your form i-130 has been approved except otherwise youfiled concurrently.

This isn't true. You can file with a pending I-130 provided the priority date is current, which the OP indicated was the case at the time they filed.

Hello everybody so i'm just gonna post it here since this is the most current thread (At least I think it is) about my question:

I read everything in this thread and correct me if i'm wrong: so a USC spouse can file AOS while he/she is in US, even if they came as a tourist (it will be forgiven?) while I-130 is pending or while they are in the NVC stage and the priority date is always current?

And they should file for EAD (work permit) and AD (Advance Parole that allows you to travel while) the same time.

 

So did I understand everything right?

Many of the questions that seem to come up here are because people have not read through the process properly, obviously there is always the chance of the odd situation arising and what we see on here a lot unusual relationships.
