221g - Interviewer said we need a new cosponsor

Looking for any advice or thoughts on our situation: 

 

My husband had the nterview today and was given a 221g requesting a new Co-Sponsor. 

They didn't let me join him, and he doesn't speak English, so we don't know why yet and was just told send an email. 

 

I live abroad with him, so my income 0. My mom filed the I-864 for us, her income for 2016 was $48,800. However, she filed joint taxes and her husband shows a business loss. We did not have her husband sign an I-864a because of his business's financial situation. My mothers financials and assets are completely separated. The house is solely my mothers, cars, everything. They don't even have a joint bank account, let alone any debt together.  

 

At the interview, when asked about my step father, my husband somehow said (in broken English) that my mom is the co-sponsor not my step dad. And handed over the documents I gathered, including end of year end pay stub, updated employment contract, and a note of explanation. But the agent pulled out the 1040's, handed everything else back without even glancing over the content.

 

This is a bit unfair in my eyes considering, there was not a translator available to him and the agent disregarded the evidence completely and focused only on 1040's of past years instead of evaluating the co-Sponsors current income.

Timeline

Why didn't your husband chose to have an interview in his native language? That is generally an option at the embassy. Perhaps you could try what was advised and send an email asking for more clarification. To confirm, you provided your mother's W2? You could always try again in the case your mother's financial situation has changed in 2016 to submit her tax paperwork as soon as she files.

He did ask for a translator. First in his native language, then in Russian which is also standard here. Other employees can and do speak in all three languages, however he got the unlucky window of an English only speaker. 

 

We had all three years of w2s, 1040s, and transcripts. Her income alone has always been a little over the 125% line. For 2016 her income went up a lot though, and we provided her current contract through July of 2017 and year end pay stub showing her gross for 2016. The agent ignored those papers completly. 

 

I did go ahead and ask for clarification by email as well.. waiting on the response.

That's really unfair that he ended up with only an English speaker. Jeez. :ranting:

 

Let us know what they say in their response. Maybe they simply need your mother's husband to send in the I-864a as well? It might just be a case of that document missing..

If he requested the interview in his native language when asked his preference, and mistakenly he was called to the English only window he definitely should have indicated the mistake and requested a new interview

 

Are you trying to indicate that you already provided the W2 for 2016?? To me that is what they are looking for is 2016 tax information. Have your mom file ASAP and send the info to the embassy.
